Tier 2 general visa is not automatically given for 5 years. there are 2 categories, 3 years or less, or 3 years and more. Both have different fees for both main applicant and dependents. Employer can enter the sart date of the new cos from anything from 21 June 2015 (1 day after your current leave expires) to any date before. the 28 days rule kicks in from the time you receive your documents.
So as long as u apply within 28 days of receiving your rejection, you should be fine. (to be on safer side, apply within 28 days of the date of rejection on the rejection letter)

Does the company hold a sponsor licence?
from what i gather the way you are saying it, i dont think the company is a sponsor, and legally, it is the company who needs to do all the sponsor licence and then assign a COS.

if you were to find a sponsor, u can change t tier 2 general, but it will have to be from your home country. you will need a restricted cos and RLMT needs to be done.
your partner can then change to be your dependent within uk.
your 5 year clock will reset once u change category.
