Read the Pedro case - http://www.bailii.org/ew/cases/EWCA/Civ/2009/1358.html - which states family members do not have to be dependant in country of origin. I second Obie's comments, although in a way I would suggest that they remain in-country and remain if here if they pursue an appeal, that way they can attend the hearing! An EEA2 application attracts a fee of £55, I would suggest going ahead, don't forget their appeal continues even if they leave the UK. If you continue to support them when they have left the UK and the appeal is pending you can produce that evidence of continued support even though it post dates the...

Dependency does not have to be proved if they are members of the household and that can be in the UK. If they were extended family members that would be a different matter, but they are direct family members and members of the household in the host state, the Pedro case sums it up well - http://www...

You need to wait until the 5th Anniversary of your marriage. As he never made an EEA application whilst you and him were living together and un-married he cannot claim to have been recognised as a family member of an EEA national prior to date of marriage.

If your mother and father are living with you and your wife in the UK and your wife is an EEA national with PR, they can apply in-country for EEA Residence Cards as dependant direct family members in the ascending line. If she remains in the UK you can make the return trip from India on your own to join her again in UK (provided she has been there for less than three months or if longer is exercising treaty rights )

It is always possible to reapply for a Family Permit and try to address the reasons for previous refusal, after all the dependency issue should relate to a period in advance of the live application, and the dependency period that was looked at by the tribunal and ECO is presumably some time agao now...

Family permit expiration is only in relation to entry clearance and its 'expiry' will not prejudice her lawful residence in UK.

Don't forget that if EEA family member is accompanying the non-EEA national to the UK, the EEA national does not need to be a qualified person and the family permit should be granted.
