So the child need not do anything until the outcome of the appeal?
that would be my understanding, they could apply for a residence card themselves and introduce evidence to rebut the inconsistencies in the parents application/interview.

Re: Is EEA family permit still valid?

The family permit is not revoked. Revocation would create a free-standing appeal right which would be notified. Obviously though the EEA family permit is only evidence of, but not proof of, an underlying right. As the parent has appealed that would secure the child's position for the time being, as ...

Re: EEA2 for Parents currently on visit visa in UK

Option 1 would be the way to go. You may want to look at the 'Pedro and Secretary of state for work and pensions' case, which will give you some hope. Dependence or membership of household before coming to UK is not a prerequisite.

Re: Right to work if my EEA case is awaiting appeal date fir

I don't find your post particularly clear, from what I am assuming you have applied as extended family members, probably received a COA with no confirmation of right to work and now have been refused the EEA residence card and are appealing. As extended family member applicants without the right to ...

Re: UK citizen (N.Irish) and US spouse wanting to return to

Thank-you for your reply, el patron. The giving up of my British Citizenship (I've never had anything other than a British passport so haven't claimed the dual citizenship option in the past) is a last resort. I would really prefer not to have to go down that route unless all other options are exha...

Re: UK citizen (N.Irish) and US spouse wanting to return to

Presumably you have thought about whether you should rely on your entitlement to Irish Citizenship and give up your British citizenship to rely on EC treaty rights in the UK without doing surinder singh? Obviously (and particularly in the NI context) you would have to be sure about such a step. As r...

Dad is a worker, he can apply for retained rights on termination of his son's marriage to EEA national Well I did not dispute that , if I remembered correctly . Re: Cease to be a family member of Eea.

By virtue of 10(5)(c) a person has to show they meet the requirement of 10(6) (a) or(b). Therefore meeting the requirement of 10(6) (a) or 10(6)(b) is not sufficient for a person to maintain their rights of residence. They will also need to show that 10(a) (b) and the optional provision of 10(d) ar...

Re: Cease to be a family member of Eea.

It is a very unfortunate state of affair. The lawyer is clearly wrong and appears to have no understanding of how the regulations operates. If you are able to secure retention of residence, and if it can be shown that your dad is dependent on you , then I see no reason why he will be unable to reta...

You should not apply for FLR (FP) or FLR (O). You are a family member of your step mother and nit extended family member. You are entitled to the right of Permanent Residence. I hope you have exercised your appeal rights I agree with Obie. In addition, the first family permit or residence card shou...
