The Residence Card will give her an in-country right of appeal should the Immigration officer have any concerns.

Alternatively route her return via Dublin and enter the Common Travel Area thereby, thus avoiding overt UK Border scrutiny!

Just for clarification, I wonder when you say the father has 'custody', is that in the from of an order form the Irish courts? If so does the order allow you to take the child out of the Irish 'State'?

I disagree with el patron . Dual British/any other nationality is treated solely as a British citizen in the UK. It is not limited to the EU. Although your EEA husband will be applying for the FP, the form will almost certainly require him (I'm not sure) to disclose that his relationship is through...

The other thing to remember is that if either of your parents were born in Ireland you do not need to bother with the foreign births register, just apply for the passport with proof of parent's place of birth.

Yes but 'P's EEA national status only becomes relevant upon marriage to the non-eea family member, so the argument can be made that the surinder singh period only exists from then, unless the durable partnership is accepted pre-entry to the UK in the form of a family permit, or perhaps an EEA reside...

Yes Vinny thanks for that, that is in my mind too, though I remember one success from last year on appeal, so the OP could similarly have to go down that route in the UK.
