There have been instances(seen in this forum) where Tier 2 General was refused as HO thought the applicant was 'pre-selected' as he/she was already employed with the same company on a dependent visa. So, beware

Re: Query - Tier 2 (Established Staff) VISA Cooling off Peri

yes, as you apply for a fresh entry clearance the transitional rules(for Established Staff visa) will no longer apply. The major implications which I think would be are: 1.The job should be of NQF level 6(For Established staff, the requirement was only NQF level 3) 2.Your pay should be >= £41,500 ex...

Re: Query - Tier 2 (Established Staff) VISA Cooling off Peri

Hi Poper, Thanks a lot for your response. I went through section 245GB. So does that mean, 1) There is no 12 months cooling off period for Tier 2 ICT visa issued before April 2011 as per 245GB e (ii) ? yes 2) Once the Tier 2 ICT visa (issued before April 2011) expires in UK, the applicant can go ba...

Re: Tier 2 ICT to ILR after 6 april 2010

However, in 2015, my company sent me home to Asia to apply for a Tier 2 General, which I obtained, and that gave me 5 more years to 2020. Also you could not apply for a Tier 2 General visa as soon as you moved to your home country as you already were a Tier 2 main applicant(Tier 2 ICT). A 12 month ...

Hi sunnynocloud

Your story does not seem to add up.
How did you switch to Tier 2 ICT Established Staff in 2012?
Established Staff visa was made obsolete in April 2011

Hi mate

Belfast is within UK. If you find a job within the UK, the employer will need to sponsor you for a Tier 2 General visa

Hi

I think you can travel back to the UK with the same employer before your visa expiry if your employer does not intimate HO to cancel your visa. Check with your HR on the same.

Re: Tier 2 ICT options

Unfortunately not many options: 1. Your spouse could get a Tier 2 General sponsorship and you could continue to work as a dependent 2. If you could find an employer who is willing to pay you > 155k per annum, you may not be subject to 12 months cool off for Tier 2 General 3. If your spouse is a Sett...

Re: Tier 2 General to Tier 2 General - cool off?

I think cool off period applies since you are technically not switching from Tier 2 G to Tier 2 G as you've already left the UK. Your's will be a new Entry Clearance There are exceptions for Shortage Occupations and people who had their Tier 2 granted before April 2011 https://www.gov.uk/government/...
