Would the situation qualify that he is economically self-sufficient and has comprehensive healthcare in the UK? We have a lease together, and bills are in his name etc.

If your spouse is a frontier worker, then the burden is on you to demonstrate that such is the case, by providing the relevant evidence, that he is employed in another member state and he returns to the UK at least everyday, or as a rule, once a week. it's not latest. it's same application since 2006 Section 4 is for NON EEA national If he/she retained right of residence under EEA law ( 3 years marriage ) You can only apply Retained right of residence after 3 years. And the application you send is EEA2 not EEA4 You can only send EEA4 five years ...

You should be able to apply for permanent residence on form EEA4 now, provided you have been living with her for 5 years and during that time he has been continually exercising treaty rights. You are not eligible for ILR in any sense or in any category. Currently, under your EEA family member status, you will be eligible for permanent residence in November 2015.
