Re: Tier 1 (Entrepreneur) Extension refusal 245D(c)

Rafarox, Your case is not the only one here that has been rejected by the HO and you dont need to try satisfying all the rules applied by the HO. As i said previously that if you could provide all necessary evidence then you might argue this in court. When you send your application to the HO. It is ...

Re: Tier 1 (Entrepreneur) Extension refusal 245D(c)

Rafarox, [quote](ii) ‘Invested’ or ‘spent’ excludes spending on: (1) the applicant’s own remuneration, (2) buying the business from a previous owner, where the money ultimately goes to that previous owner (irrespective of whether it is received or held directly or indirectly by that previous owner) ...

Re: Tier 1 (Entrepreneur) Extension refusal 245D(c)

Dear Rafarox, I totally agree with Zimba. It's well explained. Can you tell whether you bought the property under your personal account or business bank account? If we want to debate about the rules and policy applied by the HO. Then it's not going to be nice for others who are trying to help you he...

Re: Tier 1 (Entrepreneur) Extension refusal 245D(c)

Dear Rafarox, I understand your frustration about this and how complicated this is for you. However, it won't get solved if we don't understand the whole picture about what's going on. Has your application got rejected? The main objective of being Entrepreneur is to create business and expand a busi...

Re: Tier 1 (Entrepreneur) Extension refusal 245D(c)

Samisosa, I totally agree with Zimba that your chance to win on AR or challenge the case against HO is slim as you were granted to create a business, not to buy assets. I understand where you're coming from. Your case is a little bit grey. But in the business point of view when you bought a petrol s...

Re: Tier Entrepreneur extension Refused - business investmen

Yes, That's right. My case is quite strange. I can also confirm that i got a refund of £200 for my IHS and yet, the decision is still being refused. I can only think that they worker might have rejected my file and approved the others if they did 2 cases at the same time. I could tell you in this in...

Re: Tier Entrepreneur extension Refused - business investmen

The business is started from the beginning and not take over or joining the business. If you're aware previously. I was awarded and everything is fine. I understand what accounts compilation is. I think either joining or take over or forming a new business, you'd need to produce unaudited account an...

Re: Tier Entrepreneur extension Refused - business investmen

The reason that they did not award me for business investment is as below

" as specified under appendix A of the Immigration Rules - if you have provided unaudited accounts you must provide an accountants letter"

We have therefore unable to award points for attributes.

Re: TIER 1 EXTENSION APPLICANTS PLEASE JOIN HERE

The HO is really a joker. Your reason of refusal is too general and can be applied for anything. I'd assume the case worker is just someone who doesn't get training and not knowing about the work. I hope your case is going to be sorted out. When you put your fresh application. You should have waited...

Tier Entrepreneur extension Refused - business investment

Hello. Another update from me today. I have just been refused again today. The refusal letter came today with the explanation that they couldn't award me for the business investment. It's just another ridiculous reason from the Home Office. Some of you may remember my previous thread that i did have...

Re: FPS/ RTI- Help Needed

The answer is no. Your current accountant will not be able to get the FPS done by your previous accountants. Unless they transfer all the data transmitted to HMRC provided they also have the same system of doing the FPS or RTI. HMRC can help you to restore your FPS and Everything if your computer or...

Re: Tier 1 Entrepreneur Extension Approved w/o Interview !

If you have invested 200k and don't make any profit. You are still entitled to have wages as a directors. Any amount that you make from your salary and if you were to put back to the company. This will not be counted as an investment. Directors are classified differently in terms of tax or employmen...

Re: Tier 1 Entrepreneur Extension Approved w/o Interview !

You can pay yourself if you form as a limited company. However, if you were to put back that money to the business, then that money is not considered as an investment and this is called "directors remuneration"
Hope it helps.

Re: Tier 1 Enterpreneur point based leave to remain Refused

Sogar, The best option for now is to apply AR and you will have to point the statements out from which statements and state that they failed to calculate from the other statements. I don't see why you are at the wrong if those investments are from your personal accounts and can be identified. If you...

Hello Sogar, I am sorry to hear that your application got rejected. What I can only understand as below 1 that you submitted your new personal bank statements which show the transfer from that account to the business. (£88000) 2. You closed your old account where you transferred the the amount of £1...

Although i did submit different documents, but they just simply didn't accept it. I wen...
