Re: Surrinder singh arrivals claiming benefits

Yes, Casa, it's the exact interpretation of the HRT that I'm trying to understand. The verbiage is very vague. The interpretation of "short stay" could be one day or one year. It is this I am trying to clarify. Words have meaning. The interpretation of it makes a big difference ... and it'...

Re: Surrinder singh arrivals claiming benefits

Thank you. I read that and am wondering if there is an interpretation for "British national returning from more than a short period abroad."? "Short period" is very subjective, as is the entire phrase posted above. To me, it sounds like it is referring to a British national who i...

Surrinder singh arrivals claiming benefits

Hello: After going round and round the Mulberry Bush (getting married in Vienna, moving to Malta to establish treaty rights [self-employment], and finally -- after one year ticking off requirements -- we (me - UK, husband - non-EU, son - non-EU) are finally in London. Malta was simply a pit-stop on ...

We flew to Malta on Dec 19th, a few days ago. Architectually, it has been a bit of a disappointment as I've seen prettier destinations, but the people are warm and friendly, and the sea views are fantastic, so no complaining. I have sent out about 20 job applications this week. I can keep you update...

Just in case you are wondering, here is an update for you. :-) My husband and I booked our flights from Vienna to Malta. We showed up at the airport more than two hours in advance just in case there were problems. We wanted to make sure we would have time to sort any issues out before flight time. W...

I haven´t applied for the Irish Visa yet, possibly tomorrow. We needed to get an apostilled, English translation of our marriage certificate. He is not the father of the child.

" You can certainly fly ahead, but I recommend that you do the full visa application before you leave. And it is NOT clear what his status would be in Austria if you have left. Certainly he would not have a clear and strong status as family member of an EU citizen. " This is the reason for...

I know exactly where I want to go -- to an English-speaking country. And soon, like today, tomorrow or next week. I have an 11 year old child who needs to be in a school at the start of the school semester and he speaks only English. Hence the reason for my questions here. There is urgency. I could,...

Yes, we live together. The reason I decided on Ireland to exercise my treaty rights in is because they speak English there, but another poster suggested Malta. Would he be able to board a flight to Malta from Vienna airport, since Malta is also Shengen? I called the Irish Embassy and they said that ...

So you are saying if we crossed the border into Slovakia or Germany, for example, to start a fresh 3 month stay there, no one would stop him at the border? Would they give him a Shengen Visa at the border?

Excellent suggestion. Thank you.

Can someone tell me how I can get a Shengen Visa for my husband in Vienna? This seems the logical route because all of our documents are already translated into German (for the wedding) and because our marriage certificate is in German.

My husband and I are both in Vienna. I am a British citizen and he is Tunisian. I would like to exercise treaty rights in Ireland, not Austria. So how to get him from Austria to Ireland legally?

Husband deportation order dated for 3 days after our wedding

Hello: My husband and I married on Nov 29th. When we began planning our wedding one year or so ago, he was an asylum seeker in Austria. Because of the language and cultural barrier, it has taken us close to a year to get all the documents we needed to get married. During that time, his asylum hearin...

I get that one would have to prove EEA rights or immigration rights (at some point). That is a given. I am asking specifically what would happen if my husband and I chose to ignore the rules and we showed up at the border without a visa, as the poster a few posts above suggested we should do in Irel...

I guess my question is: Would they allow my husband into the country and allow him time to resolve his immigration status, or would they turn him back at the border and not let him enter? I am asking for a realistic scenario of what would happen in this case. I understand the rules for the EEA FP an...

I was asking, because I read somewhere that a UK national and his non-EU wife showed up at an entry port and were allowed to enter under a "Code 1A" stamp, which allowed the spouse to live and work for 6 months. For me, this would be ideal, as my husband would be able to accompany me into ...

What would happen if we just showed up at the UK order with no visa or a short stay shengen visa?
