Re: COA EFM - no right to work?

The same thing happened to me: applied for EEA2 with FP and received COA stating they can't confirm right to work. From my understanding and what I've read, this seems to be standard when applying as unmarried partner, unfortunately. And I might be wrong here, but my understanding is that you are in...

UK Limited company in Germany with Van der Elst visa

Hi, I am a Non-EU contractor in the UK, with a Limited Company, and I have a possibility to perform a contract in Germany. The contract/assignment would be temporary (6 months, initially at least) and I would return to the UK afterwards. This seems to fit what the Van der Elst visa is meant to do. M...

Re: What happens when continuity of residence broken?

Yes the EU National was with me for maybe 7 of the 9 months.

Does that impact my status and RC in some ways.?

Re: What happens when continuity of residence broken?

The 9 month break would be for contract work abroad (Gibraltar to be more precise). Mostly continuous but with a few trips back to England in between. And yes, you're right, I misread the statement from UKBA in the link above. They look at the 5 years from the qualifying period, not necessarily from...

What happens when continuity of residence broken?

Hi all, According to this post, you will not break continuous residency if you are away for 6 months or less in any given year. And a year apparently is defined as anyone of the 5 years that a Residence Card gives you, from the first day it is valid. http://www.immigrationboards.com/eea-route-applic...

UK Residence Card continuous residence in Gibraltar

Hi, I am Canadian, unmarried partner of EEA National and I have a 5-year UK Residence Card which allows me to stay in the UK as long as my partner is also with me in the UK. I now have an offer to go work in Gibraltar for an initial period of 6 months (my partner would be joining me and try to find ...

Re: Unmarried partner with FP - COA says no right to work.??

@toofan: what a joke.!! Unbelievable... Some interesting info I found in European Caseworker Instructions (chapter 5, page 7): http://webarchive.nationalarchives.gov.uk/20140110181512/http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/ecis/ Only if a person has been recognised as a...

Re: Unmarried partner with FP - COA says no right to work.??

I should have got a CoA with right to work, that's what I thought and still think... But I didn't. :( Now, the CoA clearly states that I shouldn't contact them and that they won't revisit the terms of my CoA, I think that if what Jambo and Obie point to is correct, then UKBA clearly f**ked up, and I...

Re: Unmarried partner with FP - COA says no right to work.??

I'm gonna ask the question this way then: Has anyone ever receive a Certificate of Application (COA) WITH right to work when: you are unmarried partner and; you applied for Family Permit as unmarried partner of EEA National and; you entered the UK using this Family Permit and; your EEA National foun...

Unmarried partner with FP - COA says no right to work.???

I don't get it. Everything I've read up to this point, got me to believe that if you are unmarried partner AND apply for Family Permit AND enter the UK with Family Permit AND applied for EEA2, then you should receive a COA confirming right to work, based on the fact that it isn't the 1st time they h...

EEA2 10.11 How long have you lived in the UK?

Hi, I'm the Canadian partner of an EEA National and I entered the UK with a EEA Family Permit in November 2013. I'm now applying for Residence Card using form EEA2. Question 10.11 is: How long have you lived in the UK? Provide details of absence of more than 6 months. Considering I previously lived ...

What if the gap in employment (and still NOT looking for work) is spent in the UK, not abroad. Would that trigger a self-sufficient period which in turns triggers the need to get CSI? Thanks.

CSI when temporarily not working or seeking work

I've read dozens of posts to try to understand the requirements regarding CSI when applying for Permanent Residence, but I still need to clear some confusion. My situation is me, Canadian non-EEA national, and my unmarried partner EEA national (from Portugal) will move to the UK using a EEA Family P...

I'm unsure of how I should answer some questions in the VAF5 form. How long do you intend to stay in the UK What am I supposed to put here if I don't know how long I'll stay? Yes as long as your partner is exercising treaty rights. I suggest you send the EEA2 application as soon as you gathered enough evidence required (simplest application is if your partner is working but there are other ways to exercise treaty rights). I think being a job-seeker is also a way of exer...

Hi, First of all, thanks everyone for the very informative, detailed, useful info and knowledge that is being shared on this forum.
