I believe that as long as it was no more than 28 days after the fiance visa expired, you should have no issues. They changed this last year.

Thanks, I am just a bit flustered as I requested my passport back today(applicant) as my passport is due to expire. I assume ukba will need a New valid passport when they process my application...? Does that mean my application will be withdrawn? Not sure if it makes s difference that Im Canadian??

I don't believe that if you request an applicants passport back (as long as it is a legitament cause) that your application will automatically be withdrawn. Although you need to be very clear when sending the form that you DO NOT wish to withdraw the application.
