Also check for any CCJ's issued against you since the parking tickets were issued long time ago and it's possible that council opt for county court judgment against you for fines. Could you clarify please what is CCJ's and how to check them? I found this https://www.gov.uk/county-court-judgments-cc...

Parking Charges and ILR

Hi, I am posting this question on behalf of my friend. He has sent his SET (0) (Long Residence) form recently. The question is: will any unpaid parking charges effect his application? The story might sound silly but this is life and people doing strange things when they are young, but still... The s...

Well, from all what has been written above I see that it is not a straightforward case and if I file it myself I might have problems. May anyone recommend a good solicitor or at least point out where should I look for a good one? It would be nice if it was a section on this forum about solicitors ex...

Thanks Obie. Can the application be refused at all or will they just send it back asking for more documents? And also in case of divorce do I need to prove that he is working just at the time of divorce or that he was working through all the time that we have been married? I mean to say if nisi is d...

You are right. Of course there are statements, but my spouse refuses to cooperate therefore I would not get them. So I need to find a solution and act quick... We did not file a divorce yet so I decided to send EEA4 form now - as it seems to be easier that way than retain a right of residence later....

yes that is right but business account statement shows the broader picture of trading activities and the same caseworker most frequently but not always want to see. Sorry for my dumb questions. Do you mean bank statement? I do not have that... What else might be used? And if I won't supply the bank...

And also may I ask - should my EEA spouse prove that he has not been absent from this country for more than 6 months in a year? And if he should prove it would be the same tax return statements be a profe or do we need to show letters dated no more than 6 months between them? Thank you.

The most important evidence that the caseworker most frequently asks is the account statements indicating trading. Could you specify please. Tax returns seem to satisfy that someone did some trading and paid taxes and therefore returned overpaid tax. Am I right? So may I assume that tax returns for...

Yes, I have my spouse's self assessment statements for last 5 years Is it really going to be enough? I have read some posts saying that there should be a lot of proof, however nobody says what exactly needed. And in EEA4 guidance it says that evidence needed which shows income earned from self-emplo...

EEA4 is 5 years' tax return and NI contribution bill enough?

Hi, everyone. I am non-EEA family member and filling EEA4 form. My spouse is self employed. Is it enough just to supply EEA national's 5 years tax return forms and his NI contribution bill with the form? Thanks

How to prove a continuity of residence of self-employed person in UK? I thought that letters from Inland Revenue and Tax Return Forms for last 5 years would be enough... But Obie stated that it won't. I do not have his payslips or bank statements or accountant's letters, though I have his accountant...

I just went through this case http://www.bailii.org/uk/cases/UKUT/IAC/2012/00142_ukut_iac_2012_bb_ors_jamaica.html. Thanks, Obie, for your useful and practical advice. I had a feeling that it might work without my spouse's passport as it was not mentioned in The Immigration (European Economic Area) Regulations 2006. Of course it is not 100% but it worth a try. And this is good news. The bad news is that my spouse...

Ok, thanks Obie. They refused his EEA3 because he did not send any documents with it. But I have now his self assessment forms for last 5 years so I think this will be enough to prove that my spouse has resided in the UK for a complete 5 years period in accordance with the EEA regulations. The only ...

Thanks, Obie. From your reply I understand that you suggest me to apply for PR before divorce. Correct me if I am wrong. In the EEA4 form it says that I need to send my spouse's passport as well as proof of his self employment to verify that he was exercising Treaty Rights in UK or is the passport n...

It seems you will probably qualify for PR, on the basis of the information you have provided. Waiting for a divorce may take longer. I know the passport may be a requirement, but it is not absolute, as they had seen it before. You may be fine. Thanks for your reply, Obie. Sorry, I did not quite und...
