Re: British citizen with EEA unmarried partner - EEA FP for my extended family

I have British citizenship and have been dating my EEA partner for 3 years now. We plan to get married Summer 2020. I would like my 2 brothers and a sister present and if possible relocated. Visiting visas are very hard to fulfill requirements and I failed twice wasting money as well. a) To apply f...

Re: Divorce from EU partner after having settled status under EU settlement scheme

Divorce would have no effect on your immigration status. If you have a BRP, as opposed to a PRC. you would have to notify the Home Office of any change of name.

Re: a belgian citizen can travel with his wife ith F card to uk

My understanding is that people in the south of the UK (e.g. Liverpool) have to travel to London to apply. You cannot apply for a Family Permit inside the UK, so I'm unsure what you want to refer here (but see my last paragraph on a general discussion of costs of Family Permits). For comparison, I ...

Re: Eu settlement scheme for girlfriends daughter

My interpretation of what you say is that your girlfriend's daughter was issued with a British EEA residence card because she was the child of the durable partner of an EU citizen. When you girlfriend ceased to be the durable partner, both she and her daughter lost the right to be in the UK. A resid...

Re: a belgian citizen can travel with his wife ith F card to uk

For comparison, a French Schengen visa for the spouse of a British citizen in the UK is not exactly cost-free. A family permit is a right for family members, and again, is free. Is far from being a fair and direct comparison of a Schengen visa, which is a permission, is given to tourists, and is co...

Re: Irish citizen apply for settled status?

Yes can do but there is no need to as Irish national has same rights as British anyways. Not yet. The Immigration bill that was lost when parliament was dissolved would almost have given them the right of abode. (Deportation for criminal activity would still have remained a possibility.) Until thos...

but if she dont take family permit to enter uk. Is there any reason why you don't want to do the Family Permit? You have already been told twice this is the documentation she should be obtaining. One reason would be the cost and effort of getting a family permit. For comparison, a French Schengen v...

Re: Family life in the Common Travel Area after Brexit

The CTA predates the UK and Ireland's membership of the EU, and its scope are confined to Irish and British national, and has no application to their non EEA family members. That's not quite true. As can most clearly be seen from Article 24 of the The Immigration, Nationality and Asylum (EU Exit) R...

Re: Has brexit turned the UK into a rogue state.

This is a lawless government, with a leader that is unfit for office. How did the UK get to this sorrowful position?, what did the UK do, to receive such punishment? The UK complied with your wishes: I actually would like them to vote to leave, so Scotland can make an easy decision to leave the uni...

Re: border control and EU's spouse without residence card

Is it possible to cross border and come back without too much trouble, even without the residence card but instead the passport + marriage certificate ? If the marriage certificate was issued by an EU country and you can reach the border, it should be straightforward to cross it. Airlines are gener...

Re: EEA Family Permit (EFM) expiring, waiting for residence card

The immigration lawyer I spoke to said differently, that if my application was rejected I would be overstaying from the date at the end of my FP. I believe the law is untested on this matter. The argument is that the family permit and residence card for an extended family member are to be treated a...

Re: Right to work: Tier 2 to EU settlement

Since you are married to a EU citizen with Settled Status you have the right to work anywhere you please in the UK, legally, and this right starts from the date of your marriage (if married in the UK) or from the date you entered the UK as married (if married abroad). That isn't necessarily so. You...

Do you think there is any chance for settled status? We both married outside of the UK before coming here.
You will both qualify for settled status once you have lived here for 5 years.

She needs 5 years residence under the EU rules for PR or the settled scheme. For the settled scheme, it's just 5 years together. Unlike with PR, he doesn't have to have been a qualified person for the whole of the 5 years, so long as there was no decision to expel him from the UK in force during th...

Except, RC and FP issued under the EEA route are not visas, but confirmation of rights; and are not issued under UK Immigration rules.
Except that RC and FP for extended family members confer rather than confirm rights, and are thus like visas.

Re: Irish Citizen, Chinese wife - UK Visa

Firstly, what is the visa process for my wife as a Chinese national married to an EU citizen to live/work in the UK? She applies for a 'family permit' to travel with you. The variant under the EEA regulations will be slightly easier; she won't need to satisfy the ECO that she is not an EEA national...

Re: Will I get settled or pre-settled status?

A simple principle to remember is that any time you change categories, the immigration clock resets to zero, though the time spent in the UK does count towards Long Residence. Except that the EEA/EU clock runs in parallel. However, the OP's clock didn't start until she married. I did not quite unde...

What about the passport being from Subsidiary Protection and UKVI not giving the option to choose this kind of document and only stating that the original Syrian documents are required? Politely insist that TLSContact accept that travel document; remind them that it is the place of UKVI to reject t...

Re: Will I get settled or pre-settled status?

What I was not expecting, is after three months, not to have gotten anything at all. Bucharest to Calais is a long way to walk. If you try flying without an EEA family permit, your wife is very likely not to be allowed onto the plane.

I suggest speaking to the settlement scheme resolution centre. They would normally accept evidence other than the one you mentioned, e.g., bank statements. As you only need to cover 2 months this way, it may even work with the online application (there is a limit of 10 documents you can upload). Us...

2. Is my wife's residence card the article 10 card? No. If it were, it would be valid for 5 years. 1. Do we still need to apply for the EEA Family Permit? Only to fly to the UK, or just possibly for a less direct ferry route. In principle, your passports and Romanian marriage certificate will enabl...
