Hi everyone, I would like to know if it is possible to apply for an EEA family permit and EEA2 in the following case: 1.BC and non eu citizen have been living in Italy for about last 6 and half months. 2.BC exercised treaty rights as a student enrolled in a language school where he was studying Ital...
A friend of mine has been issued with a schengen visa but unfortunately he won't be able to travel as some unexpected things came up.
I would like to know that if he doesn't use his visa will it affect his future applications as he doesn't want to jeopardise future applications.
Many thanks.
@Donutz : Thanks for your post. From your post it is clear that a person won't have any problems travelling within the Schengen if they have been issued with a residence card from another Schengen state and it doesn't matter if they are travelling with or without their spouse. However, would a perso...
Hello, my Family and I are currently living in Germany. I'm British and my husband is American. We have lived here in Germany for about 7 months now, after moving here as a last resort just to be together. Recently we heard about the Surinder Singh route and thought that might be a good option for ...
I was wondering if a holder of Residence card issued by Schengen country can travel visa-free to other Schengen states without being accompanied or joining the EU citizen.
Any replies would be appreciated.
The good news is that according to the judgment on Case C-456/12 a person can be in self sufficient category in order to trigger rights for their non-eu family member to return back to the home state of the eu-national. But the bad bit is that UK hasn't amended the regulations yet which means that y...
We are planning to stay in Germany and use Surinder singh route for us to return back to UK.
I hope things go well and will definitely keep the members posted.
My wife is British. We are living in Shenyang.
We will be travelling together so I guess a one-way ticket should hopefully be fine. I really don't fancy paying for a return.
He was also never asked anything when he entered Amsterdam on a tourist visa. I was behind him every time but they never once looked for me. I'm sure the UK is different but Schengen countries don't seem to be so worried! Chaoclive could you please tell us whether your partner had a return ticket o...
I have heard that 6 months continuous absence is enough to break residence, never mind 12 months! I'd always thought that single absence not exceeding 12 months is fine for important reasons. However, I'm not sure if one can be away for short visits to other countries after being away for 12months....
Would the continuity of residence be broken if non-eu and eu partner both left the country for 12 consecutive months for study. The only person who will be studying would be the non-eu partner. Also after being away for 12 consecutive months, would a person be able to go on short holidays which woul...
Dear members I was wondering if some one could explain the continuity of residence according to the directive. As far as I know a person is allowed to be out of a member state for upto 6 months in a year. However, a single absence is allowed for 12 months for important reasons such as study, militar...
@Alkb: I think an applicant has to provide proof of EU citizen exercising treaty rights if he/she wants to apply for Aufenthaltskarte. Correct me if I am wrong though.
First of all thanks for information. Second yes terena.oakley you are right about every country having different definations of comprehensive insurances. After some research I have found out that in Germany the CSI must be acceptable by German Financial Supervisory Board (the BaFin ) BaFin have a li...
Hell everyone, Could anyone please clarify that in order to get a residency card under self sufficiency for Non EU family member of EU citizen, do both partners need to have CSI or just the EU citizen? Second, when applying for PR under self sufficiency, do both partners need to have CSI or just EU ...
Hello, Most regular members might remember my previous post where my application for Schengen Visa was refused by French Embassy in Beijing. The reasons were marriage certificates etc. When I applied last time my wife was not in China. Sorry for late reply.I've been very busy recently. Here's the update: As my wife is not present in China at the moment so the British Embassy here wont issue the proof of marriage. They need the BC to be in China for them to issue the documents. My wife is planning to come to China in a months time o...
Just spoke to British Embassy in Beijing again today. They said they can't legalise the document as they told me before but what they can do is that If i make an oath in the Embassy, they can provide me with a letter stating that I'm married to my wife who is a British national and this would be on ...
Also regarding appeal, do i just have to write the cover letter, add marriage certificate and other documents and post it to the adress provided or is there something else that i gotta do too.
Any info?
