Make your way with your wife to UK by coach(not by plane) take your marriage certificate with English translation and residence card. At the border request for admission to UK with code 1A stamp, get some paperwork with you which confirms your rights. If you insist on applying for FP there is a big ...

Well in our case obviously it was probably much easier just applying for schengen visa and then doing the rest of the way by coach, but still I was hoping that our rights will be acknowledged in the light of all evidence we provided before. So in my case the question 'why' goes down to the issue of ...

I mean that if IO would become aware of refused application for FP, be aware of appeal right and admit to UK because of this right. Well the reason this crossed my mind is because sometimes people can choose to have oral hearing, or in case of refused appeal they may need to appeal further... And to...

There is no appeal court abroad. It is always in the UK even for applications made abroad (FP can only be applied from abroad). What I meant to ask is whether having right to appeal allows me to cross the border to UK in order for continuance of appeal? In other words also, Can appeal per se consti...

Quick question about appeals

Does the refusal of FP gives the right of appeal in-country if the application was made outside of UK?

As far as I can recollect the application online lets you choose whether it's family reunification or just a visit. You could choose appropriate option to your status while in Ireland.

She has an absence 1 year from uk but she came back working and living in uk currently when she was not here that we did not have bills and etc... I reckon they will refuse my appeal again and send me home after I worked 5. Years and paid all my thousands taxes and being legal here. If they give re...

You can always try, make your case very readable and easy to track, but i think most importantly you would need to show that there is no doubt that there is something really deep going on between you and your partner. Many people have problems even though they are married for many years and have chi...

You have a right to join your wife in UK, but no one here could assure you that your application will be successful. You just need to apply and see what happens, if you are refused you have appeal rights or you can reapply.

I would suggest you act quick if you have only 1 month..

My opinion is it won't as long as you they don't intend to settle down but only came there for a visit within validity of schengen visa. But from my experience calling institution in Poland which is responsible for issuing residence cards for non EEA nationals, there is no issue at all concerning pr...

As an USA citizen I think you don't need visa to enter to UK, therefore you don't need to apply for visa which suppose to only facilitate entry for those who are visa nationals , once in UK you will be able to apply for residence card when your partner is already employed.

definitely complain now, however don't expect much from European Commission, Solvit is more likely to help directly with your problem, but their timelines for coming up with solution is at the least 10 weeks.

how long before your residence card will expire? For processing family permit you will need about 3-4 weeks, if you still have over a month time you could apply in Cyprus I believe if successful it will save you money and time.

The application form only requires you to state criminal convictions, this is only offense, I don't think you are obliged to state it, if you have no criminal convictions.

Personally I would not state it.

Theoretically your past immigration history does not affect your present right to accompany your wife to UK, however there is some possibility that at the border, the officer may be aware of it and perhaps make it complicated for you to enter. YOu may want to have basic knowledge on how to argue you...

I suggest you don't apply for FP I have very similar situation with my wife who was removed from UK, You will mostly likely be refused visa and you will waste much time. If you don't want to waste time, make your way to UK with your wife and marriage certificate, they ought to give you entry stamp a...

Just apply for schengen visa there may be trouble, but its very likely also you will get it quick without any trouble. If you have still time for your trip you have a lot of time to get this sorted. By the way why would you not want to get visa if is free of charge, and the only requirement is your ...

Justinyk, your wife does not need to prove that she can support you in UK, she just needs to give evidence that she is exercising treaty rights, which means working, or self-employed or self-sufficient. On your part you just need to provide passport and marriage certificate.
