Pablito, When do you want to move to the UK? Appealing seems to take about 3 months or so... Directive, I have appealed already, and we will also try to get to UK by end of this month, if it doesn't work we will stay for awhile in Poland, until this matter is resolved. But I hope we can get into UK.

Guys, I will be appealing today or tomorrow. It is my first time in my life to appeal, but my idea is to simply say that I think decision made is unlawful because of Articles 8(5) and 10(2) that state that in order to acquire entry visa I am only required to prove "family link" by showing m...

Canuck, you don't have to answer question about your main reason to travel to UK, from here follows that whether its vacation or finding a job, you have entitlement to change your mind, so if they ask you whether you intend to work in UK and you answer "no" still you would be entitled to c...

Directive, our latest refusal does not state that our marriage is one of convenience but that our marriage is not "subsisting", I would think that this is already different refusal acknowledging that our marriage is not of convenience.

canuckUK, In my opinion Directive is right all about legal side of it, but in practice you may want to think what you really want to do. My suggestion is , let your application form looks like you are both going there for a visit, because in reality once you are there you are entitled to change your...

Do click on my given links. The first of these is Papajorgji (EEA spouse – marriage of convenience) Greece [2012] UKUT 00038 (IAC) , in which the tribunal notes that there is no burden on the applicant to prove that a marriage to an EEA is not a marriage of convenience. The tribunal goes on to high...

I had received administrative review thru email from Visa Manager, in which the lady states that she don't find anything wrong about decision, and yet she thinks that "durable relationship" in refusal letter amounts for "marriage of convenience" from the previous refusal, so for ...

Re: IMPORTANT

=> we will get marriage in July in TUNISIA . 1/ she will be able to apply from UK for eea visa for me ??!! Better would be to apply EEA family permit in the presence of EEA national in order to promptly clarify any suspicion arise towards the relationship in embassy if needed. Sheraz7 My wife and I...

No problem.

To be honest with you this application on UKBA website should be completely reformed, they musn't ask you those questions at all, It is against the spirit of EU Law. Hopefully something will change soon...

My opinion is, make your application that your wife will be traveling with you to UK for a visit, not settlement. You don't have to explain or inform them that you intend to live there or work. If you really want, show them that you both have jobs in your country or whatever else, but don't expose y...

Personally looking at your case I would not apply for UK visa, but schengen visa to any EU country, then make your way to UK. Looking at your age difference, and the fact that most likely you will want to apply just after you get married, you may be suspected of marriage of convenience, and despite ...

If you can't amend your appointment online just cancel it and make a new one with new reference number. I think this reference number is most important to them when you go there.

No problem, wish you success.

John is right, but in practice it may go wrong. How about just trying without any additional information for now, other than the application itself requires. They most likely would ask for additional documents if they feel they need. If they ask for details, you can always deal with it as you go, ra...

You don't need to cancel it , because this application online doesn't go anywhere. All you need to do is apply online again and make amendments to your appointment in Worldbridge or VFS centre with the new reference number that appears on your new application form.

Are you outside uk with your wife right now? If you are going to uk to settle it is better for you not to say that you are going to settle, you can make new application.

Dear Sir/Madam (Visa Manager) I am writing to you, due to the decision made on my application for “Family Permit” as spouse of EU national. I believe the decision made was in breach of EU Law (Directive 2004/38/EC). The Entry Clearance Officer dealing with our application had come to the conclusion ...
