Second appeal determination arrived today with award of 140£ also we had been paid already 80£ for previous appeal.

At some point I'll try to find time to write both determinations here.

Jestew, If you are already married in my opinion it wouldn't be so straight forward removal. But I would really consider this optionoption as a risky one. In my own view you could do that, but I would strongly recommend you having proof of legal stay in UK when you apply because you may get yourself into some sort of problems and refusal. Yes you're right, but I didn't want taking chances with possibility that we would not be admitted to UK and our appeal right was lost. Also I believed that if we ignored our already second refusal for FP that would tantamount for greater doubt about our credibility in case our application for reside...

Adding to John's suggestion I would also say that refusal of Family Permit does not mean that she can't really get it if you continue to fight for it, but of course it may take time. Schengen Visa should be much easier to obtain once you are already in France working.

My wife's new passport is with my surname so there wasn't any problem in proving that she is wife of EEA and can work. 2 passports having same surname doesn't prove that holders are married. Imagine how many other non-EEA women living in UK may have same surname as yours in their passports? I can't...

She had an exit stamp at port in Calais, so I think this is obviously proof that she has entered UK at that time and date, otherwise where else she could be?

Yes we are going to apply for EEA2 very soon once I get my contract.

I am not sure if I remember correctly but I think Diomond tried to marry British person in UK and was removed (I may be wrong). It is possible to get married with EEA national without being removed but this is not a guarantee. I think it depends if there is suspicion that marriage is of convenience....
