Section 3(5) is not applicable, if applying under Section 1(3) . For children born in the UK, there is no residential requirement under 1(3) . Only a parent's ILR or equivalent is necessary. You may be able to apply from 28 days before 12-JAN-2014 so far as absences are <180 days per 12 month period. We have only this rule In UK BA it states that "During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months." I have not seen any limit for entire 5 years. Not sure if any exists. I am also in the same situation as you more worse...
