Re: DLA Claim for Child still under visa by parent with ILR status

DLA is a public fund, as such your child must not be subject to immigration control eg their BRP must not say “no recourse to public funds”. In terms of child benefit, it’s potential that you claiming child benefit could breach the child’s no recourse to public funds restriction, as public funds are...

Re: Is ILR settled status?

Settled status is indefinite leave to enter/remain. Pre-settled status is limited leave to remain under the EU settlement scheme. Benefit entitlement depends on (a) your immigration status and (b) eligibility conditions for the specific benefit.

Why are you not eligible? It shouldn’t be approved if you are subject to immigration control. You can contact HMRC child benefit helpline on 0300 200 3100 to withdraw a claim.

That template says, where applicable, so you can include it, for example, it may be applicable if you were a registered offender who needs to report name changes to the police.

Re: New Style JSA Backdate Claim vs ILR

All your reasons are about ignorance of the law, that doesn’t fit what the DWP would expect to see, it’s still worth a go. Remember that when you apply for an immigration application in time, your current leave continues, as is, under section 3(C) of the Immigration Act, so that one doesn’t really w...

Re: New Style JSA Backdate Claim vs ILR

When you can backdate You can only backdate your claim if you have a good reason - for example a close relative died or you were given wrong advice by the Jobcentre. You'll usually need to have looked for a job and been available for work from the day you want your JSA to start. If this wasn't poss...

Re: Claiming UC (housing benefit) with wife and child on NRPF condition

You can claim UC as you’re British, it should not effect your wife’s settlement insofar as no additional benefits are paid in respect of her, assuming you will not have other tenants on the tenancy but for you and your wife, that should be ok. Your older child, I assume has NRPF, there is a potentia...
