If you are a cross border commuter, then you live in country S and work in country G. You have residence in both countries for the purposes of EU free movement law. Residence in this case does not depend on you sleeping in a member state G. EU free movement law is originally and most strongly assoc...

Just back from the employment board and the guy that was rather helpful yesterday appeared to be completely confused and clueless.. So I requested to speak to his Supervisor. The person who then came was at least half up-to-date with the law and assured me that it is not a problem and that my wife a...

Ok thanks. Just to know what would happen in the worst case scenario.. My job is quite safe at the moment.

Will be going to the employment board with all the documents in about 2 hours and hope to be successful.

What would actually happen if we now get this stamp, my wife finds a job and I would happen to lose mine and not exercising treaty rights anymore... Would she immediately lose her right to work as well?

Right, just back from the employment board and I was told that we have to go there (work permits section) with Passports, marriage certificate and proof of employment and the statement then was "We'll take it from there..." As onlineamiga said before, they will most likely rubber stamp the...

Thank you for the advise. It was very helpful... SO I am correct in thinking that I can first apply just for a schengen visa ( no need for a residence visa ) then once we are in spain we can then apply for the residence permit... having an appropriate visa will not be an issue then? I would say so....

Morning,

May I assume that you are currently living in the UK together and you hold a valid British residence card?

Also what is your nationality?

You can absolutely travel to Spain together with him, or join him after. Just not before him.

Regards

If you have proof that employers are required to apply for a work permit, then we can work to quickly change that. It might just be that your employer does not actually understand the rules. Absolutely up for it! We went through a lot of **** in the last 2 years and if I can help others from doing ...

Thanks a lot!!

I think the biggest problem here is the lack of information..

If we are successful with all this I am going to write a long report to make it easier for others in the future! 8)

Might be a bit far off, but how about temporarily moving to Ireland with your hubby? It's not your home country, so you can take him with you under european law. Find some little job there, and then return to the UK after a few months under Surinder Singh.. In Ireland you would also be closer to you...

Thanks! I have just been talking to my HR and was told that we currently have a case of an Argentinian married to an Italian husband, both working for our company, but she still had to apply for a working permit for the Argentinian wife... I will update you when I got some news from a real authority..

You keep quoting a lot of stuff which is not relevant to your situation. Do not get distracted. Can you please guide me back on track and tell me what is relevant for my situation? You are considered a cross border worker. You live in one EU member state and work in another. Your spouse can definit...

Well, she can apply for the Gibraltar ID card when living in Gibraltar, but not whilst still living in Spain... She can freely cross the border anyways, as Brazilians do not require a visa for Gibraltar (neither Spain). If the Gibraltar ID card is directly connected with the right to work, I know wh...

You or she could also continue to live in Spain and both work in Gibraltar if desired. She can apply for a Residence Card, but can not be required to do so in the first 90 days. In the UK it is not required, but I am not sure if it is required or not in Gibraltar. The following applies to your wife...

Thanks a lot! I never had the idea to just submit some of the documents later.. But if that's possible without problems, we're good. Also I was told by my future HR that those kind of residence cards are usually issued within 2 to 3 months, unlike in the UK where it usually takes the full 6 months.....

Irish EU 1 app - supporting docs

Hi there, I got a question regarding the supporting documents for a EU1 (non-EEA national who is the family member of an EU citizen). I am european and I used to live with my Brazilian wife in the UK in 2010 under EU treaty rights, then we went to Spain where we still live at the moment and the next...
