It could go either way I think.. Technically the visa expires after 6 months of absence if I'm not mistaken, however, the Irish seem to be a pretty relaxed bunch when it comes to that and she might be fine. Probably best to send them an email.

Well I am of the view that for Qualifying family members of EU citizens, reconnable residence commences from thee first time they entered the state, even without a stamp. We entered Ireland together that day so doesn't make a difference. Do you know if we have to apply for permanent residence befor...

We decided in the end that it is the best solution to stay in Ireland and wait for naturalisation here, which is probably less complicated and faster.

Thanks guys, I know it's a bit late but I'd like to inform that we didn't encounter any problems whatsover. Instead of the apostille, we just got a notary public to notarise the marriage cert and included previous residence cards from the UK and Spain. Stamp 4 has been granted without questions. :D

No problem. When entering Ireland, they will actually probably put a stamp on the passport saying that you have 30 days to register with the GNIB. There is little point in doing that as it will cost money and won't change anything for the non EU citizen as they would not give a stamp 4 at this stag...

Send the form EU1 first. Once you get your acknowledgement letter, go to the GNIB to get a temporary Stamp 4. 6 month after they received your form EU1 you will get a final decision letter. I remember that we didn't need the apostille for the uk application, whereas in Spain we did need it..
