But proving her relationship with her son is through birth certificate not marriage certificate. Why did they not even look at the other evidence provided. Hmm I think they have bitten more than they can chew. Complete mess.

Ei, yawuo o. Kofi75, sorry to hear about your case. Something is wrong somewhere. How on earth could they use this excuse and for them to take that long to come out with that is ridiculous. Is your wife British or settled? No,we fall within their own scope judgement.Just a flimsy excuse to refuse t...

Hi James, if you have not yet posted your forms, I asked my solicitor and he said print put the e payslips and include your bank statements that should show the same amount going in and the company name. He said this should be ok. And as I said, include in your cover note. Good luck.

Wow, I cannot believe this.then who will get RC under zambrano? When did u leave UK with the child? Why did they not ask for evidence the British father cannot be an alternative carer. I'm so surprise of the wording in the refusal. I will go and read regulation again. Sorry to ask so much. Where did...

I think a lot of companies urs e payslips now. I think if you can get a letter from your company to confirm this, it should be ok. I'm not an expert, my thought. But theres not much you can do if you don't get paper payslips. Include explanation in your cover letter too.

I asked because if they said they don't include children with settled parent, then no one will get a DRC under zambrano. To be British, one parent has to be British or settled. So it they did not consider the fact that you are the primary carer(the tern used after 8th Nov2012 instead of sole carer), ...

I think the only west African country whose proxy marriage certificate is accepted for RC purposes is Ghana. Nigeria has never had theirs accepted cos its not in the constitution and therefore I believe the country itself does not recognise it. Apart from you mobismome, have you heard of anyone succe...

Wiggsy, I can understand your frustration. It is just too much for any human being to handle. I was debating with a friend today and it seems one might die out of frustration before they act. And would be quick to open an inquest. We are treated like animals with no say and yet they talk about equal...

Hoping something good comes out of this. I like the way they said ' relegated'. That's exactly what it is. Discri...

@Prince74, if I'm right, did you not apply through a solicitor? Can we communicate directly to ukba and vice versa even when a solicitor mediated? In your case, do you think they will send decsion to you or your solicitor? Your last COA was sent directly to you. It's that right? One thing is that I'm...

The funny thing is as they refused her, they told her she qualifies under article 8 but since dat was not what she applied for, they gave her a link to follow if she wants to apply. I am sure this is a ploy to get most Zambrano applicants to apply under the immigration rules so they can get some mone...

As far as I know,if you don't qualify, they would normally reject and return your documents to you. If they receive your application, check and you submitted everything required, and you meet the criteria set, they would normally issue COA with right to live and work depending on your individual circu...

It's an acknowledgement letter given after submitting an application under zambrano. It gives you right to live and work until such time your application is decided.

Ukba has recently said time spent under eea regulations cannot be used to add up to 10 year long residence for ilr. I believe this was only referring to time under EEA regulations with derivative rights (Zambrano), not the "standard" rights. Sorry yes,I got carried away. It is derivative ...
