Re: ILR new 180 day rule

This is an extract from Homeoffice website http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/modernised/cross-cut/ilr-calculating-continuous/ilr-calculating-continuous.pdf?view=Binary "No more than 180 whole days absence are allowed in any of the five, two, three or four con...

Thanks Kevin. I am applying for ILR in 3 months time. But still I guess to be on the safe side, i will have...

Yes I see your point. But in extreme scenarios when people have to decide upon applying for tier 1 extension when something goes wrong with the ILR application. My understanding is that it doesn have to be an UK bank account as long as you have enough funds in another account under your name. The a...

ILR funds maintenance

Hi Just to confirm with the exeprts here. I realise that for an ILR application there is not set rule that the applicant has to maintian £900 for 3 months unlike Tier1 applications. But just incase if I had to show the maintenance funds, does it has to be from an UK bank account? or will it be ok if...

Just to make thing clear here. I see some people still posting the fact that they were not away for more than 90 days within a given year. My understanding is that the 180 day rule per year (from dec'12) is still valid?!?

cheers

ILR tier 1 (general) new rules from 6th April 2013!!!

Just checked on UKBA website that minor changes will be done to work-related settlement and will be rolled out form 6th April 2013. I've gone through the statement of changes: http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/statementsofchanges/2013/hc1039.pdf?view=Binary But the...

180 day rule. Too risky to take it for granted as of now???

Hi all Just a quick thought. So a 180 day/year out of the UK is standard after the new rules in december'12. I have been out of the UK for around 85 days now and I am booking a holiday for another 3 weeks away from the UK very soon. So this will add up to 85+21 days = 106 days altogether. Is it too ...

OP, I think there a few different points/questions being made here. 1) Did you break your continuous residence in the UK? I don't believe you have broken this requirement, as your absences are clearly under the allowed threshold. 2) Can you use those earnings to claim points for your previous earni...

You need to give reasons for ALL absences (look at the form). You don't need to supply substantiating evidence if less than 180 days. These are two different things. yes every absence is to be mentioned in the application form even if it's less than 180 days. But does that mean the continuity in th...

During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months. The absences must be for a reason that relates to the purpose of your leave in the UK, or for a serious compelling reason (such as a serious illness). Working at a European comp...

Thanks Bildor

Got those documents. However I thought for someone on Tier 1 visa, don't have to submit employment letter! I got one anyway so not that much of a problem.

thanks a lot

Hi All To keep it short and easy: I am due my ILR this september 2013 as I have been on Tier 1 (general) for 5 years by then. As usual I need to show my earnings for the past 1 year by then (sep'12-sep'13). My question is I have worked in Europe for the past 5 months and was wondering if I can show ...

query: new rules on absence outside UK.

Hi All I will keep it short and simple. I know the ILR rules from 13th december 2012 clearly states there shouldn't be any absence for more than 180 days per year outside UK. Now I have a 85 day absence in a calendar year (not continuous, just all together). So do I need to provide the details of th...
