Re: 5 Year rule

I am not entirely convinced that the Home Office accesses APIS for the purpose of verifying presence or absence from the UK. It would then not need to ask for your passports as it would have all the data already and would only be trying to make the application more onerous. Besides, Europeans in gen...

Re: After UK passport issued can I still use my old one?

will the fact that a UK passport has now been issued mean my naturlisation certificate in my Australian passport is no longer valid? I believe, from the tenor of the original post, that the OP has a CoE-RoA attached to his Australian passport. The issuance of a British passport does not void a CoE-...

Re: Possible reasons for non systematic delays?????

Google and ye shall find!!! Seriously, it is faster to search for things like these on Google than wait for a forum response. The list of countries whose nationals are considered high-risk is confidential and exempt under Section 27(1) of the FOI Act (information can be withheld where disclosure wou...

But that is precisely my point. The rules have not changed. Good character is a broad concept, whose interpretation would and does change over time.

Re: effect of changes to nationality: good character

hi guys, I have a few questions to the gurus here: 1. the changes are effective from 11/12/2014 and they are affecting decisions and not applications. So, any application submitted before this date and no decision is being made yet will be subjected to these changes. my question is, is this legal? ...

Re: 5 Year rule

There will be entry stamps for other countries in your passport, which is why you need to submit all passports (of all nationalities) held by you for the period of five years. It is more difficult to prove if you are an EEA citizen and travel within the EEA. However, even then, it is possible to ask...

Just to clarify: "the other is settled in the UK" in the previous post typically means that the other parent needs to have ILR as well.

Re: Clarification on the Requirements for Naturalisation

Being free of immigration time restrictions means having ILR. As ban.s has mentioned, as spouse of a UK citizen, your wife can apply for naturalisation immediately after getting ILR, rather than waiting for a further period of 12 months. But having ILR (for non-EU citizens) or PR (for EU citizens) i...

Your surname is your family name. So the details mentioned in the original post are incorrect. I presume that you want to distinguish between family name and given name.

I would say that this query would be best responded to in the Other Countries forum, rather than the British Citizenship forum.

As an aside, the date of the citizenship ceremony is slightly ironic, is it not?

Re: BOTA - British Citizenship referee - Unmarried Partner

The UK issues visas to unmarried partners of UK and EEA citizens precisely because they are considered part of the family.

I would recommend getting a different referee. If you can't, make sure his contact details do not give any indication that he lives with you or is in a relationship with you.

Re: Surrendering Indian Citizenship - Lost Indian Passport

I think the Other Countries forum would be the best forum to post this query in. However, here is my tupenn'orth. The best people to advise you would be the Indian High Commission. My feeling (just a feeling as I have not had the situation) is that as you have the photocopy of the passport and an of...

Right of Commonwealth citizens to participate in public life

Are you saying that Indian, Australian and Canadian citizens that are not British nationals can vote in British elections? Citizens of Commonwealth countries (section 4.6 of the Representation of the People Act 1983 http://www.legislation.gov.uk/ukpga/1983/2 ) resident in the United Kingdom on a vi...

Re: Can minor have British & Indian Passport until 18

To the best of my knowledge, the situation is more nuanced than that. A child who is entitled to both British and Indian citizenship at birth can retain both of them, unless he takes any action to exercise his British citizenship, such as by applying for a British passport. This action, even if done...

Re: I cannot find a way for my American girlfriend to Englan

The advice below is predicated on the presumption that you are a British citizen. The procedure for an EU/EEA citizen resident in the UK would be a lot simpler under EU Regulations. How long have you been in this relationship? If it has been more than two years and you can prove it (online chat logs...

Re: Can I travel to Germany with my UK Travel Document?

Which UK travel document do you have? What is your current status in the UK? To the best of my knowledge, only UK citizens has visa-free access to Germany. So, if you are on ILR or LLR (limited leave to remain), you will need to apply for a Schengen visa, which is typically always granted, on the ba...

As per your statement, she has an Indian passport, so the answer to the first question is "Yes". And you will need to send the Indian passport with the application. All uncanceled passports of all countries need to be sent, not just British or EU passports.

Re: HOW DOES THE SYSTEM WORK?!

I might have completely the wrong end of the stick, but I think part of the delay can be on the quality of paperwork submitted and the complexity of the case. By the latter, I mean that the spouse of somebody who gets his wages paid into a company and then is remunerated in dividends is more complex...

I would suggest that you write to your MP's office making him aware of the issue. Given that it is the Christmas period, I would suggest writing after the New Year.

Re: I apply for British citizen in June 2014 and still dont

Most government departments have a section that deals directly with MPs' correspondence, as they can question ministers in Parliament and embarrass the government. That can speed up up your case some time. So, provided the case is older than 6 months, you can write to your MP or call his office. To ...

NHS services are free in specific circumstances only. The Scottish Government guidance http://www.scotland.gov.uk/publications/2008/03/14162503/4 lists specific circumstances when overseas visitors get free NHS services and when they do not. While the guidance is specific to Scotland, the rules for ...

My tuppenny worth, but I believe reading somewhere (and confirming it with the Immigration Rules, Part 8, page 8 onwards) that even in an arranged marriage, the couple need to provide evidence of having met at least once before marriage. I believe that the rule was brought in to combat both sham and...

"Good Character" requirement - tougher rules suggested

John Vine, the retiring Independent Chief Inspector of Borders and Immigration, has issued a scathing report on the Home Office's handling of citizenship applications. He has broadly suggested that the "good character" requirement for citizenship is not being applied rigourously enough. Gi...
