Re: Issue with Citizenship

I'm not so sure that one needs to be on an ICT visa to have the kind of arrangement that the OP suggests. If the OP is on an ILR, I'm sure the employer can work something like the scenario envisaged by the OP out. I would suggest that the OP discuss this with the HR department and see if they can wo...

Re: ILR before citizenship?

To the best of my knowledge, ILR for non-EEA citizens/PR for EEA citizens is a requirement for all naturalisation (as opposed to registration) applications. If a spouse of a British citizen, the applicant can apply for naturalisation immediately after getting ILR. But they will need to be two separa...

Re: Issue with Citizenship

It is certainly a plausible solution to the issue of keeping your Indian citizenship and ILR alive. That way, you can be resident for tax purposes in India, while being actually resident in the UK, thus keeping your ILR alive. You will certainly need expert tax advice in both the UK and in India. Be...

Is he applying for naturalisation or registration? Which form does he intend to use?

Re: Issue with Citizenship

Or of course, you could go for option 3; pay the differential. Given that you have probably paid a fair bit to get to the citizenship stage in the UK, I would suggest that you factor that in as a part of the cost of citizenship and accept it. I would declare the British citizenship to the Indian aut...

Re: Just a Sunday question

Under section 40 of the British Nationality Act 1981 (as amended), an order to deprive a person of their British citizenship can be made if the Home Secretary is satisfied that: it would be conducive to the public good to deprive the person of their British citizenship status and to do so would not ...

Re: ILR before citizenship?

You will have to apply for ILR.

I believe that after you get ILR, you will immediately be able to apply for citizenship as the spouse of a British citizen. But you will need to go through ILR in any case.

Re: Issue with Citizenship

You are talking of current immigration law. In immigration law terms, three years is an eternity and they will almost certainly have tightened either ILR or citizenship requirements by then. The EU announced just a few days ago that the UK has the highest number of new citizens in the EU in 2012, on...

Re: UK citizenship when born abroad?

As your father was born in the UK, he would be British otherwise than by descent and be able to pass his citizenship to his children, provided he is married to the mother of the children and is named on the birth certificate. As you say that both the conditions above are met, you are British by desc...

Re: Issue with Citizenship

@Ginza, ILR and BC are not necessarily similar. You can lose ILR if you have been absent from the UK for more than 2 years. It is a leave that can be revoked by the ECO at the airport if he thinks that, within reason, you are not living in the UK on a permanent basis. BC, on the other hand, is a per...

Re: More Migrants given UK Citizenship in 2012 in EU

In this case, the headline figure of 193,900 is for new citizens of the United Kingdom, not for new passports. I guess the reporter for the Gruaniad, err, sorry, the Guardian, (from which the text of the original post appears to be sourced indirectly) used new passports as a metonymy for new citizen...

Re: Very typical case - please advise / help

The child is British by descent . It is also Indian by birth. However, if you apply for a British passport on its behalf, the Indian citizenship will be automatically revoked. Incidentally, in the OP's initial post, I presume that he is referring to the child's conception, not his wife's. :D In any ...

Re: OCI or PIO Card -> UK born kid

Was your child born in the UK after you or your wife got ILR? Or have they been registered with form MN1 after your wife and you got ILR? If not, they are not British and therefore can not have a British passport. They would of course be eligible for an Indian passport. On the other hand, if they ar...

Re: Double Descent Citizenship?

In order to give a proper answer, it would be necessary to have more details, such as the following; a) When and where was your grandfather born? b) When and where was the parent through whom you claim UK heritage born? These questions are important because the key years that UK citizenship laws cha...

Re: Are they doing passport interview

Passport interviews are a requirement for all first adult passports, including for people born British citizens. It is not a requirement for naturalised citizens only. If you have a look at TheStudentRoom, a student oriented forum, there are discussions there about passport interviews too :)

Re: Citizenship passed on from parents/perm residence/spouse

I would say that it is fairly certain that you are British by descent and should be able to apply directly for a UK passport on the basis of your father's birth certificate and your birth certificate. It does mean that your children are not British, unless they were born within the UK or have claim ...

Re: Citizenship passed on from parents/perm residence/spouse

I am no expert and would defer to others on this forum far more informed that I, but I would say that given the circumstances, you likely are British by descent, provided you can prove that your father is British. It would help if he was born within the UK himself. Have a look at Page 2 of the Guide...

Re: Citizenship passed on from parents/perm residence/spouse

As your father is British, you might be able to claim British citizenship by descent. In order for us to assist you further, we would need further information. a) Can you advise us of your year of birth? b) Were your parents married at the time of your birth? c) At what age did you move to the UK? You can be resident anywhere in the United Kingdom of Great Britain and Northern Ireland. So long as you are resident in Northern Ireland and not in the Republic of Ireland, it counts.

I can confirm that they do. Mine was delivered by courier (The DX) the Saturday before last.

You can reach them on 0800 0197847 (not absolutely sure that it is their number) or at www.thedx.co.uk.

Re: Less than six years? advise please

To the best of my knowledge, there is no "6 year" rule. The rules for ILR and for naturalisation are separate. The rule for naturalisation (as regards dates) is only that you need to have atleast completed one year with indefinite leave to remain AND that you need to have been in the UK ex...
