Re: British citizenship for minor born abroad with consent letter

I am curious to know why a child with Indian nationality suddenly cannot get their passport renewed ? There has been some newly introduced legislation in India that removes citizenship from children whose parents have acquired another nationality. It is not so much new legislation as a stricter int...

My visa started on 25 March,2020
What visa do you have? Is it is a skilled worker visa, a spouse visa or another visa?

Every different type of visa has different requirements and different rules.

Re: Has anyone had an MP help overturn a decision

An MP said as much in the Commons yesterday . Marco Longhi (Dudley North) (Con) I have stopped the large number of so-called asylum seekers from attending my surgeries, and I have instructed my office not to deal with asylum cases, for two reasons: as MPs we have zero authority, mandate or influenc...

Re: First Adult British Passport Documents required - British by birth - applying from overseas

I thought the same as well, and checked a few immigration law websites where they say the birth certificate is usually enough for pre1983. I am inclined to agree that a pre-1983 birth certificate may be sufficient on its own. You may be asked for proof of the parents' occupation in the UK, at most....

Re: First Adult British Passport Documents required - British by birth - applying from overseas

My husband was born in the UK in 1976, his parents were working in the UK at the time. They left the UK a few years later to India. He has recently found out he is eligible to apply for a British passport. I don't think the marriage certificates may be relevant, nor their immigration status in the ...

How long has the child been in the UK?

If the child has been in the UK for more than 10 years, then yes.

Re: Certificate of Entitlement - Right of Abode

I had no idea, upon Naturalisation - I have to immediately claim a British Passport or RoA-COE. That is not true. You only need to apply for one or the other if you need to re-enter the UK, and really only if you are a visa national. Your profile flag suggests that you are Australian. So you should...

Note that ILR and naturalisation are separate processes, under different laws and with different requirements, and assessed differently. ILR may have different absence requirements, and ...

Re: VISA TO NORTHERN IRELAND WITH PRE SETTLED STATUS

Northern Ireland is a part of the UK and Pre-Settled Status is valid over there as well. However, you can't travel to the Republic of Ireland based on your Pre-Settled Status, even though there are no border checks. That will require a visa, as Pre-Settled Status is a status limited to the UK. You c...

Re: ILR Depandent Visa or Citizenship?

Regarding ILR dependent visa, children are following the status of least privileged parent, which is your wife, in this case. That is true of children born outside the UK . In this case, the child was born in the UK, so it may (I am not absolutely certain) be able to follow the path of the most-pri...

Re: Referee a non-UK resident - child UK citizenship

Is it fine to have the child, who's born in the UK, reside in the UK without a legal residence status while their citizenship application (MN1) is under progress ? I've got my ILR in Feb 24, and the current dependent status of my child is coming to an end in June 2024. So he'll be without a residen...

Re: Naturalization as a British citizen: The urgent and compassionate case under medical urgency, please.

PS. Also factor in time applying/waiting for your passport from HMPO (not UKVI), for which no acceleration is available for first passports. I am going to emphasise this point, because a UK naturalisation certificate will almost certainly not be recognised outside the UK. You will need to apply for...

Re: FLR(M) extension - can we use a Travel document instead of a Valid Passport

Why would the Indian Government not renew your sons’ passports? India allows children to keep Indian nationality until they are 18 when they can choose. How old are your sons? The Indian government has recently changed its interpretation of the law (I believe, but am not sure, that there has been n...

No I had not lived with him as I was studying at the time and working. We were doing long distance and with COVID we couldn't get married prior to December 2020, even though we were Islamically married in 2019. Which I know isn't plausible under UK law as 'married'. OK. In that case, you'll need to...

That is to say that they left the UK on their own cost and they didn't have to be deported at taxpayer expense.

If you have ILR, presumably you were not deported at taxpayer expense.

If your husband was a British citizen on the date of birth of the child, then the child is automatically a British citizen.

Apply directly for a British passport.

Re: British Subject to British Citizen 1949

This is an interesting question and I have gone back and forth on it, as it is not quite that straightforward. To start with, the first thing to understand is that there are two underlying requirements for somebody born before 1st January 1983 to have become a British Citizen on that date. They need...
