Re: Which form for WP Dependent where WP holder has got ILR

I replied on the same day as you marked your post as urgent. It is strange that while your post was urgent you had no urgency in checking response. Ideally , you should have sent copy of passport as well.
Anyways, if HO needs it then they will write to you and at most it might delay decision .

Re: Tier1 General + Tax return

You need to show HMRC letter to your previous employer and get them reply to notice. Check with them whether they paid correct tax or not for you during that period. In my opinion you must sort this out before going for ILR.

Re: Dependant of an ILR

She can continue on dependent VISA unless she qualifies for ILR. Ideally you should apply for her ILR once she is eligible.

Re: Which form for WP Dependent where WP holder has got ILR

SET(O). WP dependent . Your daughter needs to apply separately on SET(O) as she is over 18.
You need to attach copy of your passport and BRP along with the application.

Re: ILR Query

Just keep original WP and P60 with you but no need to produce it unless demanded. I don't think you will be asked any questions as for many applicants who have shared experience here salary was increased only in last three months to meet the SOC requirement and they were successful.

Yes. immigration rule states that but generally you don't need it when absence is <=180 in each qualifying year.
it is based on the experience shared by forum members who have got ILR without it.

Re: Dependant 2 year requirement

She is eligible . There is no absence limit for dependents but it should be limited and for good reasons. If asked , you just need to explain why she was away especially for 4 months in year 4(Year 4 and 5 can be considered as residence requirement) . That's it.

If your abscences are less than 180 days in each qualifying year then you are fine. Don't bother too much about it.

Re: ILR in 10 days - Long Absence Question

I had applied based on 5 years rule and i was actually here for 5 years only . But if you search in this forum many people have been advised to mention 4 years 11 month and they were fine.
Basically , application is focused on qualifying period and CW understands it much better than i do.

Re: ILR in 10 days - Long Absence Question

I had got it right first time itself . You aren't noticing what i'm trying to highlight . " 7.11 how long have you lived in the UK? Years Months Please provide details of any periods of absence of more than 6 months during that time. " It actually refers to the qualifying period because of...

Re: ILR in 10 days - Long Absence Question

There is no such guideline but there is definitely a question regarding the date on which the application is based on . Also , it clearly asks to mention absences during the qualifying period only . Where is the guideline to mention absences which is outside of the qualifying period ? In the total s...

Re: When will I be eligible to apply for ILR

You should have applied in 2012 itself based on five years WP+T1 route. I think now you can apply based on 10 years long residency. Whoever spouse VISA was issued after July 2012 rule they have to be on that VISA for 5 years before they qualify for ILR . So , i'm not sure about your letter.

Re: ILR in 10 days - Long Absence Question

Your ILR is based on 5 years continuous stay . In the SET(O) from you need to put march 2009 in the column where it says, "First Entry date on which the application is based ". Also regarding your stay you can mention 4 years 11 months(or 5 years based on tier 1 visa stamp date) . You don'...
