Well I sent EEA2 on 19th July. My employer received the result of ECS from home office on 20 stating " I have checked our records and I can confirm based on the evidence we currently have that this individual is not currently entitled to work in the UK on the basis of an outstanding applicatio...

ROR is not an automatic rights. The real question is whether Direct Effect principle extends over the ROR cases or not. Retaining rights of residence is under the provision of the EU law, not the UK domestic law. Do you know any reason why of a sudden the Direct Effect principle should stop working...

I read very carefully. So I stands on my claim that after divorce non EEA national must have to inform HO with the request of ROR,in case where marriage lasted 3 years. And if marriage lasted 5 years then non EEA national can apply PR. If readers believe on my stand then good enough. If readers dis ...

Yes that's the problem. And after divorce non EEA nationals have no choice except to follow the uk home office procedure. Why can't you back up your claim? You seemed to be relying on the HO letter accompanying the first RC which isn't relevant to RoR. It's for those who doesn't meet the requiremen...

This is unclear so far but what uk saying is that.. 5.1 Divorce or annulment of marriage / dissolution of civil partnership The case of DIATTA (ECJ 267/83) established that a spouse did not cease to be a family member in the event of marital breakdown/separation until such time as a divorce was fina...

I think something is wrong here. From what I know and read, RoR gives you automatic right if you fulfil the requirement for RoR. It isn't compulsory that you inform the Home office about your divorce and if you choose to, they'll expect you to make application for RoR and if you are successful with...

Hence we are in an appeal process. In case it fails we will need to apply for another 5 yrs on the basis of my w...

If you read the last line of the letter which you received with your RC,then it will clear on you, that you have to inform HO in case your family circumstances ever changed. HO can revoke the RC in all cases in which EEA national leave the country, ceased qualified activities, ceased to be a family mem...

Yes.

You have to inform HO once your divorce finalised.

And if you not apply new RC ROR,then your old RC will be revoked.

EEA2 applied 22/11/12 COA received week later but with no right to work ( did not bother us , as my wife was pregnant at that time ) straightforward husband and wife with no kids or other family members application rejected after more than 7 months ( I have suspicion that they were deliberately dra...

As I read your first post that today you received a letter in which HO refused your application, and at the moment there is no application pending in home office,so I assume that employers checking service may not confirm your right to work.Your employer will receive an email within 2 or 3 days. Yes that's all you are require.

I advice you to go in your local county council office and ask for check in service.

They will check your documents and then give it to you back as they sent photo copies,so your passport and PR will remain in your hands for urgent travel.

Imshzd, Thank you for your response. If I apply tomorrow for EEA2 , can HO force me to leave UK as my visa already expired? Any idea about Employment Check Service? Thanks. Yes I heard that.

If your husband is a qualified person since oct 08 without any more then 6 months gap then oct 13 you can ask for PR.

Apply with EEA 2 with the covering letter and request for PR.

Form EEA 2/4 does not matter.

If your husband is a qualified person at the moment then submit EEA 2 application, with all documents for last five years.
And write a letter to home office to consider PR if possible.

On this way,At least you will get RC again.

Expert's opinions needed: We we moving home within the UK. We have Residence Card and Registration Certificate, following a successful EEA2 and EEA1 applications a while ago. ok thank you. but what is the purpose. of registration. certificat then? Registration certificate is not an I'd or passport. Registration certificate is a confirmation that,at the time of registration certificate application,EEA national is a qualified person.Remember just at the time of application.

original I'd is required.

If you search this forum then you will find stories in which home office refused applications due to lack of original I'ds.
