Does not matter if you are using your ex boy friends address or even if you are living in the same building.
You married in 2009 but you did not mentioned your divorce year?
If you write down your refusal letter here then may be some one try to pin point the HO error which leads you to success.

I think in your case you and your partners joint financial commitments to meet the household are missing...
In your case it is very much clear that you two are living at the same place but there is no commitments between both of you.

You can apply RC any time after marriage.
For smother application you may sent the required documents which are asked in EEA application form.
