Re: Does a director count as an employee?

B2B - It seems like your answer isn't correct (unless its a rule from the Home Office and not a general UK employment rule). Here it seems to say a director of a company can also be registered as an employee of the company: https://www.gov.uk/running-a-limited-company/taking-money-out-of-a-limited-c...

Re: Does a director count as an employee?

Business2business wrote:Remove him from directorship and put him/her on payroll as a secretary or whatever you want and pay him minimum living wages
So you are saying a director does not count as an employee even if they are being paid as an employee?

Does a director count as an employee?

Hi all, I had a question about employment creation... I founded a UK company which I am a director of. Three months later I brought a friend (who is an EU/German citizen living in the UK) on as an additional director of the company to help me run it. Once we started making money, I began paying that...

Re: Requirements for ILR *after* T1E extension is granted

I see what the requirements are for the final 2 years of our Tier 1 Ent visa: – Employ 2 settled workers for 30/week for 12 months each. – Pass Life in the UK test https://www.gov.uk/life-in-the-uk-test – be registered as a director or as self-employed within the 3 months immediately before applyin...

Requirements for ILR *after* T1E extension is granted

Hi all, I had a question about what is required for ILR *AFTER* our T1E extension is granted. In other words, for people on the 5-year entrepreneur visa route that will be using the SET(O) form to apply for indefinite leave to remain. For T1E-specific requirements *for our last two years* I have thi...

Re: Questions answered Entrepreneur visa extension

Hi n8net, I think dnf's post is explicit and clear enough tbh. He/she stated that the business has been profitable from day one i.e. other funds were probably injected into the business prior to getting the Initial Grant of Leave and didn't have any REASON to expend the £50k as investment. In addit...

Re: If app is rejected can you reapply without overstaying?

Hi zimba88, Thanks for your reply, but I don't think that thread answers my question. I'm talking about your extension application being rejected without applying for an AR. Once your extension is rejected can you remain in the UK for 28 days from the date of rejection without being an overstayer? A...

If app is rejected can you reapply without overstaying?

Quick question: If your extension application is rejected, can you reapply without breaking your leave to remain? For example, if you initial visa ended o February 1st and you applied for the extension on January 10th, but then your extension was rejected on February 28 are you allowed to reapply ag...

Re: FPS/RTI or P11 instead?

That paragraph in the guide is exactly as written in the Immigration Rules Appendix A. Obviously it says that they will accept different documentary evidence for PAYE. I suggest you send anything you have from that paragraph. HO can easily check the information submitted via RTI with HMRC (I know t...

FPS/RTI or P11 instead?

Hello, I'm confused about submission of FPS/RTI and if a P11 can be submitted instead. My accountant's software doesn't generate a full FPS report. It's just a limitation of his software. But I have a full detailed P11 report for all employees showing total taxes taken out, start dates, hours worked...

Evidence of UK business for self-employed?

I had a really basic question: In section 103 of the T1E Guidance (11/2015) it says you must show that your business is based in the UK. For company directors, that's easy: just give a copy of your Companies House printout. But for point 1 in the "Type of Business" chart on page 29 of the ...

Is money spent on a business always a "director's loan"?

I have a question: Is money spent on running a business always a "director loan"? Can it ever just be an "investment"? Let's say an individual (John) owns a legally registered company (John Limited). John transfers money from his own bank account to his company bank account and t...

I do not need to call HO as I have got one employee working for me for long. He is not leaving after I promise to raise his salary. If the clarification is so important for you, you can call them. Thanks. Actually, I'd call them ASAP if I were you. Under the new guidelines you CANNOT employ a singl...

Re: Employment after extension of tier 1 entrepreneur

I put the whole money into the account and show it by shares. Then use the whole capital or part of it to do the business. Always keep the capital there. And you obviously started making a profit in the business before the £200k investment was already spent, correct? But as long as you showed that ...

Re: Tier 1 £50000 Extension - Business Investment

This question gets asked frequently and I think many people are just over thinking it. HO wants to see that you invested £200k/50k of your own funds and that the business spent those funds over three years and that is all. Most companies will not blow through £200k before they make any money and HO ...

Congrats! Can you please let us know: When did you apply for the extension and when was it granted (in other words, how long did it take them to make a decision)? What documents did you provide as evidence to get your extension? Have you received an answer yet from the HO if you need to hire an addi...

Re: We need to create 2 more jobs during extension for ILR?

@ JohnOhn, from my understanding of the new policy is as thus; (1) If you get the first 3yrs visa, then invested 50k/200k and also created 2 full-time job for at least 12months, then you will get the 2yrs extension. To then get your ILR after total 5yrs on the visa, the 2 full-time job must either ...
