Re: Travel to Schengen, without visa, for EEA-family members

If the non-EEA spouse has a UK spouse visa, or indeed ILR, then it depends upon their nationality. It would be necessary to look at the detailed Schengen area regulations and determine whether they need to obtain a Schengen visa.

Re: Travel to Schengen, without visa, for EEA-family members

burnleyfclee, the document you quote, it also says :- Those family members who are not nationals of an EU country [so-called third country family members] may enter the host EU country with a valid passport. If they come from certain countries which are subject to visa obligations, they may be requi...

I think you miss the point. It does not say that, but that does not mean such family members can travel without a Schengen visa.

Re: Council Tax

You are confusing two separate issues. I suggest you read this webpage. There you will see that "Council Tax Reduction" is the new name of "Council Tax Benefit", and nothing to do with the 25% Single Occupancy discount.

Re: Travel to Schengen, without visa, for EEA-family members

burnleyfclee, no, Schengen Visa required to enter any Schengen Area country.

The same will apply even when she has her ILR, and the situation will only change when she becomes a British Citizen.

Re: Gross or net for salaried employment

That is right but, correct me if I am wrong, you made an application quoting one amount of business profits. It failed, then you made another application, or are going to, quoting a higher amount of business profits. You ask if UKBA might be suspicious, and if those are the facts, I think they might...

sjunejo, I am obviously not asking you to post the whole address, but please do give us an idea where you are in the UK.

Someone might then be able to suggest where she might study and/or take the test.

Re: Gross or net for salaried employment

If we mention that the whole income is a profit, as there was no expense, in a self employed case, will that be viewed with suspicion by the UKBA?
I think the suspicion will arise from the fact that previously there were business expenses, and now there are not.

Re: Life in UK for Disable Dependent

How would it help if we go there with no preparation .......
Well clearly it would not help if there has been no preparation. I think you need to track down a place that can give tuition to a blind person, and discuss how they would take the test.

When does her current visa expire? Also in May?

Re: Life in UK for Disable Dependent

Have a look at this UKBA document , and then search for the word "blindness". There you will see :- Life in the UK test centres and many colleges can cater for a variety of disabilities, such as blindness. An applicant may be able to do the test even if they produce evidence of a disabilit...

Re: Gross or net for salaried employment

We need to be careful here because the terminology can be confusing. But the basic rule is that the amount subject to Income Tax is the amount that UKBA should use. As regards the an employment or indeed Directorship, it is the gross amount that is subject to tax. Confusingly as regards self-employm...

Amber, you are of course correct about the possibility of UKBA disregarding.

Nevertheless it would still be useful to have more detail. chorc123, am I right to think that you used to have a valid student visa, so were legal at that time, and then you overstayed?

Re: Apply citizenship after 14 years long residence

chorc123, this is actually quite a complicated matter and unless you give more detail about your UK immigration history, it is impossible to come to a conclusion to your question. I have quickly scanned your previous posts and apart from a brief mention that you were a student, I cannot spot anythin...

Re: FLR(M) Exempt from Financial Requirement

Does it make a difference to the application for a spouse visa how long we have known each other? How long have the two of you known each other? And can my partner work whilst he is waiting for the application to be processed? His last visa allowed him to work 20 hours a week and study. I understan...

Re: FLR(M) Exempt from Financial Requirement

Can I also ask is it likely to have a detrimental effect on my partners application for a spouse visa that he is applying a day or so before his visa expires? No effect whatsoever. Is he likely to be told to leave until they have decided his case? No, he will have so-called Section 3C Protection. T...

Re: Detailed Public Funds guidance

I do not think that the benefits will be problem. But as well as notifying the Council Tax office that he has moved in, you also need notify the Tax Credits offer, and the Tax Credits claim must be put into joint names. To keep that claim in your sole name would amount to benefit fraud. Expect some ...

Re: Detailed Public Funds guidance

So the plan is to get married this month, and then a spouse visa would be applied for prior to his existing visa expiring. Yes?

Before answering your benefit question, what income does he currently have? Also what income is he likely to have after a spouse visa is granted?

Wow, you have posted into this topic after a gap of more than eight years!

Nevertheless the post I made on 27.12.05 is still my opinion. But do appreciate that the amounts I quoted then, £335 and £500, have moved on a bit. Current fees are £578 and £953 respectively.
