... I am thinking about getting a Notary Public to certify the photocopies ... I hope not! A Notary Public could be hideously expensive! Instead use a Commissioner of Oaths at any Solicitors office ... much cheaper .... and just as effective for your purpose. But take care about not using an NCS of...

HMRC obviously dont want you to use an accountant where necessary as it would be less profit to tax = worse for the tax income... Well no! Less profit for the client, but more profit for the Accountant! For HMRC it might be tax neutral, or HMRC would be better off if the Accountant has a marg...

I do complete my tax return through self assessment account on HMRC website, but don't go through those details. Put my approx earning and that's it. Why? That is, why are you not putting accurate figures on the tax return? Surely you are keeping accurate records of all your business transactions? ...

Have a look at this document , and in particular go to 071179. This refers to the case of 1 De Biasi v Secretary of State for the Home Department [2012] EWCA Civ 1015. So 8 hours per week, for a period of 8 weeks was held to be insufficient to make the person a "worker". Lots of use of the...

To my knowledge there has been no tribunal case on the point that you are making. Do correct me if I am wrong. However on another EEA point, what constitutes employment to make someone a "worker", under the terms of the EU Directive, that has been tested. Let's say someone is in the UK as ...

I totally agree that there is no minimum time specified by law. However in the link you provide it does say "Each application is, therefore, considered on a case by case basis and consideration given to whether the work/self-employment was genuine and effective". Therefore a very short tim...

I think you should have a read of this UKBA wording about the way Surinder Singh works. There you will see that it is totally necessary for the British Citizen to be exercising Treaty Rights in another EEA country, and for their non-EEA family members to be living there with them. So for you your wi...

OK, so you make your business accounts up to 31st December, so the tax return to 05.04.13 would disclose the profits for the year to 31.12.12. Totally OK.

So those annual profits to 31.12.12 still giving you a good idea how much you are making now? Or are you now making more?

Kadar, as they say as regards visa applications, "get caught in the lie, wave the visa goodbye", as you know only too well. I think no one on this board, or indeed any immigration adviser, will be able to give you a guarantee that an EEA Family Permit will be issued in France. But clearly ...

sapnic, are you working 20 + 25 = 45 hours per week? Or have I misunderstood what you have posted? The HMRC needs to be informed that your wife has ceased working otherwise you'll face an overpayment. Certainly the Tax Credits office need to be told, but there would not necessarily be an overpayment....

35 days alone is not a problem. But in the 5 years to 12.02.14, how many days do you expect to have been outside the UK?

Also in the one year to 12.02.14, same question.

What would be a problem is if you were outside the UK mid-February 2009. So please confirm you were in the UK at that time.

The issue is clarified by this UKBA webpage.

So the whole family needs to be covered :-
If you are an EEA national in the UK as a student or as a self-sufficient person, you and your sponsored family members must have comprehensive sickness insurance for the duration of your stay in the UK.

miryferny, the problem is that the regulations say that they must be in a "durable relationship", and UKBA interpret that as needing to live together for at least two years. However it seems to me that it is totally possible for a relationship to be durable before two years has elapsed. So...

The company is a separate legal entity, separate from its shareholder and director.

If you are the only officer of the company, that is, if you are the only Director and there is no Company Secretary, then clearly you will need to sign the dividend voucher on behalf of the company.

Even so the Board of Directors needs to pass a resolution. Usually the Articles of Association of the company permit these things to be done by written resolution. which should then be added to the Minute Book.
