biometric information for PR - ?

Hi Do I understand correctly that, when applying for PR, we do not need to submit any biometric information for non-EU dependants with application? Instead, it seems HO will send us biometric letter, after they get our application, and with that letter we will have to then go and do biometircs for n...

Re: "proof of your dependency if you’re dependent on your EEA family member"

I believe this is not a requirement for spause and minor children.
It applies for parents, grandchildren, etc. (and even in those cases can be substituted by proof of living together), and to extended family members.

Some questions about permanent residence

Dear board members: I am preparing to apply for EU permanent residence for me and my family (I am EU member, not all in my family are), and hope someone here can help to clarify a few issues for me. 1) I know there is a service to certify passports, so we do not have to send them in. Do they also ce...

Re: EEA PR do I need to be in UK on last day of 5 years?

Thank you! Yes, I know that qualifying period can be any 5 years in the past. If there is no requirement to be in UK on the last day of qualifying period, we will all apply in September using July 2013 to July 2018. But I need to make sure this is true.. But if there is requirement to be in UK "...

EEA PR do I need to be in UK on last day of 5 years?

When choosing 5 uears which qualify one for EU permanent residence, does the person need to physically be in UK on the last day of those 5 years? Our family will get to 5 years in mid July (we came mid July 2013), but we plan to leave the country for 2 summer months. All of us can apply upon return,...

Re: Dependent parent on 5 year EEA family permit - absence?

Requirement of continuity is: periods of absence from the United Kingdom which do not exceed six months in total in any year Does anybody know how the years are counted? Is it not more then 6 months in any period of 12 consecutive months? Or is it only not more then 6 months in any of five 12-year p...

Re: EEA2 for Parents currently on visit visa in UK

On page 17 of the link I cited above it says: Where dependency is necessary, the family member does not need to be living or have lived in an EEA state where the EEA national sponsor also lives or has lived. Their dependency on the EEA national sponsor does not need to have existed before they came ...

Re: EEA2 for Parents currently on visit visa in UK

In-laws are direct, not extended, family members of EU citizen, as long as they were either dependent on EU citizen before moving to UK (!), or lived with him/her in the same household before moving to UK (!). I would think proving dependency or life in the same household (BEFORE moving to UK) is mu...

Re: When can one apply for PR?

Well, I know that formally EEA4 is only a confirmation. However, it is essential for non-EU member of a family to have it, without it there are too many problems - especially when one travels, and even in UK. However I got what you say - indeed, if an applicant acquires PR on a certain date Z, they ...

When can one apply for PR?

When a non-EU member of EU citizen family can apply for EEA4, permanent residence? The rule is 5 years, with no more then 180 years outside of UK each year, right? Our problem is that there were two absences of non-EU member during 1st year - 5 months, and then 2 month, total 7. And they were not fo...

Re: Does EEA residence card make you an EEA Citizen?

Well, for any administrative purposes she should be treated the same way as EEA citizen. However, many application forms do not distinguish between "EEA citizen" and "family member of EEA citizen" (i.e., do not have special separate category for "EEA family members"). S...

You need to fill and notarise a simple form, and send it to your wife - Form DS-3053
The easiest is to notarise it at US embassy here

Look for instructions for affidavit of support, form I-864. If she does not have enough income/saving, someone else can sign with her as your co-sponsor. It does not need to be a relative. Application can even be based on your own income/savings (US income! Like if you are already working in US on w...

Re: Applying green card for my mother

It is a common path to bring parents on green card, once a child naturalises. Status of your mother is "immigration application pending", and she can stay in US while her case is considered. Moreover, I would strongly recommend against leaving the country before she is granted green card -...

Re: Question about re-entry

Legally, you cannot use your green card if you were out of USA for more then 1 year - after 1 year out you legally lose green card status. They might let you in at the boarder, but might send you away. If you do not have to move to USA urgently, better apply for green card again via consulate (since...

Re: Need to file US tax while living in the UK?

She does not need to file US taxes if her annual income is less then a few thousand dollars. Technically, she has to file it if she earns more, but americans abroad do not pay taxes from about first 100 thousand of wage income, so she could only ever be liable for US taxes if she is a very high earn...

Re: US citizen marrying EU National

Not sure. My impression is that applying for spouse green card from abroad is more painful then from within US, and there is a long waiting period, during which he may have problems entering US temporarily (as he demonstrated immigration intentions). On the other hand, if you apply from within, they...

My guess is that you should be able to count years for both of you starting from the day your husband started to work on German passport. Re: transferring eea residence card

As far as I remember there is no procedure of "transfer". You have to apply exactly the same as 1st time. Their logic is that EEA2 is a mere confirmation of your existing rights, not a "visa". And since your circumstances may have changed, in order to confirm your rights "as...

Re: US citizen marrying EU National

You can apply for grrencard immediately once you marry in USA, and get it without leaving US. If you marry abroad you will have to apply for special visa and it takes time (but then you will get GC in the airport). You cannot just get marry abroad, come to US and ask for greencard at the airport. in...

Re: Sponsering elderly parents

It os easy to sponsor parents if you are USA citizen, and there are no age requirements. There are some issues with health insurance once parents arrive - how problematic it is depends on state they live in, and it seems it became less of a problem with Obamacare. It takes about a year now if applyi...
