Going by the previous posts you will have to return to your home country and serve a cooling period.
I would still suggest you to consult a solicitor before you take a step.
I guess they would suggest you a way out considering that you are in UK.
I am assuming you are on Long Term ICT visa.

Hi Subujoseph, I don't see anything wrong in going for the 3 years visa as well. You can extend your visa once you are in UK. @Manci, Can you please confirm my below query? If I apply for Tier 2 General visa after 6th April 2014(COS issued in March 2014) but the visa gets issued after 6th April 2014...

I have been reading the posts by some of you. I see there are telephonic interviews being conducted by UKBA. Is this happening for every application for Tier 2 General or is it case specific?

Even if they don't allow to switch to 5 yr visa once you are in UK you will be able to extend the visa for another 3 years.
I think switching in country is easier.
Most of the rules will apply for people who apply from outside UK or after 6th April

That's not good news. But as I understand the new 5 year visa is still in proposal stage which will be presented in the parliament which may or may not be accepted.
