Incredible

Dear Amber, It is hard to think that the fate of a Naturalization application will depend on the whims or knowledge of a case worker, above any specific guidance on the matter. It is also unbelievable that a definition for immigration purposes will be used differently for different purposes along th...

When do you expect a response?

Dear Amber,

Normally, how long does it take for them to respond to such information requests?

Any SLA's or timeframe withiin which they should respond?I hope to get the written opinion from an immigration judge that it is non-custodial. sometime next week.

cheers

Dilemma

Dear Amber, This is another area which needs to be looked at. How on earth would you go to a person for a reference and ask him, do you have a conviction. Many who are convicted would definitely keep it to themselves. And when you are going to someone for an obligation, this is the last question you...

Some information Please

Dear macjackbauer,

When did you apply?
When did you get your approval?
What kind of documentation did you submit while disclosing your convictions?

Complete details will help remove the concerns surrounding convictions, time frame and the decision making process.

Congrads and Best Wishes.

God Bless you

Amber, You have done a noble deed by taking up the matter with the Border Agency, else the lack of clarity would have destroyed lives. its like giving a garland to monkeys. Each border agency official would have run riot with his own imagination and meagre intellect. The migrant journey is a painful...

Some thoughts on the confusion

Learned Amber, Please feel free,Correct me if any of this is wishful thinking. English systems and laws have always set the trend for the rest of the world as far back as time goes.. The confusion about suspended sentences is because of the way sentencing evolved over time. Originally Suspended sent...

Gr8 commitment

Amber, It is fantastic to note that you have taken up something which is ambiguous with the Border Agency. From my side just to ensure the ambiguity on this is removed, I consulted 3 leading law firms on this subject and the results are 2 out of 3 confirmed that so long as a suspended sentence was n...

Thanks again

Dear Amber, Part of the inspiration is the FAQ you have put up. One can make a difference to many with some effort. Incidentally I was digging deeper and I found this and believe the HO will regard a suspended sentence as a non-custodial sentence unless it gets activated. For ILR a non-custodial sen...

Suspended Sentence

Dear Amber, You are right in saying"In calculating the threshold it is the prison sentence that counts, not the time served, and a suspended sentence counts as if it were a prison sentence" . The suspended sentence order is one in which a judge suspends the prison sentence for a period of ...

Threshold

Dear Amber, With due respect ,my intention is not to mislead or misguide. Please see this In assessing whether a particular threshold is met you must use the sentence imposed, not the actual time spent in prison. However, this does not include:  suspended sentences (unless that sentence is subseque...

This is the General Rules for Refusal Issued by Home Office

Dear Amber, The home office cannot treat a suspended sentence as custodial for one end of the migration journey while treating it as non-custodial for another purpose. Logically if what you are saying is true then what applies to the egg does not apply to the chicken. On their website it clearly sta...

Minor Conviction

Dear Amber, Some questions come to mind.. is the sentence taken into account or the disposal? In deciding whether a conviction is minor . Now say for assault there is GBH, ABH and Battery all called assault between sec 39 to 47. They dispense suspended sentences, conditonal discharges, fine, communit...

Dear Amber, So a person wil have to wait for 7 years or risk loosing the home office fees is what you say. Dear D4109125, First let me salute you for putting up a brilliant FAQ for the benefit of the board. I never for a moment thought you pulled the FAQ's out of thin air. Thanks for pointing to that terrific FAQ

Dear UKforever, That FAQ is brilliant no doubt. The question is what is the source? Is this legit Border Agency FAQ or in other words was it compiled from the actual guidance issued by the Border Agency? I am not questioning the legitimacy, just that the guide AN is silent on suspended sentences. Wh...

British Citizenship- Good Character

Folks, As most of you must know after 13 Dec 2012 the Rehabilitation of Offenders Act 1974 is no longer applicable and it is not relevant if a sentence is spent or unspent. The Border Agency has published their own thresholds and guidelines. There is a senior anamoly in the guidance issued. The grey...
