Hi there John, Yes she can apply for the second leave to remain (FLR (M)) - in fact, that is the expectation. Your son and daughter-in-law can apply 28 days before the 2.5 year anniversary of their arrival in the UK. They will need more or less the same documentation as they did for their initial FL...

There is already a minimum earnings threshold. It is £18,600 and more if there are children. This was introduced in July 2012 and this financial requirement has to be met at each stage of the process (2 x visas and ILR). It does seem reasonably likely that they will introduce a minimum earnings threshold for Family route Settlement at some stage, given the current government's form in other areas of immigration, but given that people applying under the new (2012) FLR M route won't be eligible for Settlement until 20...

Hi there, We're about to apply for our second FLR (M) and it has occurred to us that at the expiry of this second 30 months, we may fall short of the full 5 years required for Settlement (ILR).
