Re: FLR(FP) and Discretionary Leave to Remain timelines

@ Elastep please take it easy on yourself. I trust all shall be well. As the saying goes delay is not denial and I believe your time would surely come. From what I understand from your post HO have agreed to reconsider your case if you withdraw and I'm glad to say I have seen lots of people being gr...

Re: Help please, urgent!

You currently have a leave to remain under section 3C of Immigration act 1971 and that means you will be allowed to work until your outstanding application is decided provided your last granted leave to remain allows you to work. Your new employer should apply to Home Office by completing the employ...

Re: 10 years long residence applications

Hi Amjad 1) You have got 3 months to begin your JR from date of the decision but you also need to send PAP (Pre action protocol)letter before JR warning HO you may bring a JR claim. Reconsideration is another option 2 &3) Your son and wife can apply for ILR on Long Residence basis once they have...

Re: DL - LOTR refused - Settled Partner & British Children

Hi UK2013A I will certainly suggest you proceed with the appeal as your partner appeared to have a strong family life in the UK given you and your children strong immigration status. The judge will most likely explore the strengths of her case better than the HO will do. If you were to make a fresh ...

Re: 10 years long residence applications

Hello red scorpion I'm really sorry to read about your case. The HO are very mean to have treated you this way. However, I'm not sure your best line of action is to try to fight them over this invalidation. I can't quote the exact source of information but I think applicants can reapply within 28 da...

Re: Can I apply for 10 year long residence ILR ?

Hi I think it depends on when your visa is curtailed which depends on how quick your employ notify the HO and how quick they decide to act. You have no control over that except to hope there is delay either from your employer or HO. If your leave is valid upto 12/08/14 then you can apply for ILR fro...

Re: Status Update- After Appeal Allowed

Hi Mrs.P Technically you can't make a new application while you have an appeal waiting to be heard. Your new application will most likely be invalidated. You have 2 options a)Withdraw your appeal or b)Add your 10 year lawful residence status as an additional ground of appeal at the UT. The judge wou...

Re: FLR(O) Discretionary Leave waiting times ..??

Hi Nilemarques I think the applicable immigration rules you are referring to is as follows: 276ADE (1). The requirements to be met by an applicant for leave to remain on the grounds of private life in the UK are that at the date of application, the applicant: (iv) is under the age of 18 years and ha...

Re: 10 years long residence applications

Hi Scorpio81 I think your interpretation of the rules to your circumstances is both reasonable and fair. Personally, I do not think you have overstayed given your appeal was accepted by the upper tribunal and was not dismissed along that line. However, even if HO ruled that you have indeed overstaye...

I think it answers your question. https://www.gov.uk/government/publications/3c-and-3d-leave Dear Forum Members I have recently applied for my ILR on the basis of Long Residence. Following is my history Entered UK 9th March 2004 6 years student+2...

Re: FLR(O) Discretionary Leave waiting times ..??

Hi The FLR FP form is an application form for leave to remain in the UK on the basis of article 8 of Human Rights. There are 2 elements to article 8 namely family life and private life. In your case applying as a parent of a BC child falls under family life while private life relates to ties or root...

Hi
Informed by the solicitor today that determination is received and appeal allowed. Looking forward to see the decision. Now praying and hoping HO do not challenge the decision.
Any news from your end Yazzy? Best of luck mate.

Re: FLR(O) Discretionary Leave waiting times ..??

Hi Thamsinkumar I think I answered that question last week or so. Any valid application made to HO whether student, Private life or others will count towards extending your leave to remain under section 3c or 3d of immigration act 1971 (i.e. your last granted leave to remain is extended while applic...

Re: Appeal Determination Letter

My appeal was heard on 21 Feb 2014. The judge stated clearly that he will send the determination within 2weeks but over 3 weeks later I was told the decision is yet to be issued. The waiting is torturous.

Re: FLR(O) Discretionary Leave waiting times ..??

Hi Thamsinkumar I'm not very conversant with rules around maximum time allowed to study in UK so I can't answer your questions on that front. However, to answer your other question, if you make an in-time application (i.e. application submitted while your leave to remain is still valid). You will be...

Re: FLR(O) Discretionary Leave waiting times ..??

Hello Thamsinkumar I think based on the facts you have shared so far, making an application for a private life in the UK appears to be the best option. You barely have time to find a course or a job that can sponsor your tier 4 or tier 2 application respectively in addition to other conditions such ...

Re: 10 years long residence applications

Hi Amjad Have you tried putting a complaint about the continue delay in deciding your application. You can also try to involve your MP and the Ombudsman. If all these did not work try JR to get them decide your case. This is unacceptable. Do something bruv. Best of luck mate By the Grace of Allah I ...
