Re: Reagrding going on leave for a month, Tier 2 General

26.18 You must not continue to sponsor a migrant who is absent from work without pay for 4 weeks or more in total, other than for the reasons listed above. You must report this using your SMS account. This applies whether the migrant is absent from work over a single period or more than one period d...

Re: Reagrding going on leave for a month, Tier 2 General

According to the Sponsor Guidance for Tier 2 visa, the migrant is only allowed 4 weeks of unpaid leave in total in one year. The sponsor has to notify the UKVI using the SMS. If its more than 4 weeks then the sponsor would have to stop sponsoring you.

Re: Sponsor Note to adjust Salary for correct no of hours.

Last time I applied for my Tier 2 I was in a similar situation. My boss entered the wrong number of hours (42) instead of 37 and obviously the salary per hour was lower than the minimum requirement. So after talking to the then-UKBA, he added a Sponsor Note correcting the number of hours and I succe...

Re: Tier 2 Extension query

dragon098- Yeah, that will work as if you apply in November for 2nd of January start date, you would still be within the 3 month period provided you get the CoS on or after 2nd of October. aplinhar- You're welcome! If you're applying for a 3-year extension, loss of a few months shouldn't a problem i...

Re: Tier 2 Extension query

dragon098- You're right, the CoS is assigned to you instantly after the form is filled, however the job start date mentioned on the CoS can be any time within 3 months of the CoS being assigned, and you can apply for your visa anytime within those 3 months as well. So if the CoS was assigned today w...

Re: Tier 2 extension Salary requirement

Your legal adviser is right, you will be considered an "experienced worker" when you extend your visa, and so will need to be paid the experienced worker salary for this job title. You can't just change your job responsibilities with the same title and be paid the same amount, you are stil...

Re: Tier 2 visa and COS timings

Yeah, there is a question about the salary and the number of hours when they assign your CoS. I don't think there would be one during allocation though, as that's a more generalised thing. Assigning a CoS is different from getting a Sponsorship License or getting the allocations.

Re: Tier 2 visa and COS timings

They could assign a CoS to you but put the job start date as August or September. Note that just like the CoS has a validity of 3 months, the start date on it can't be more than 3 months in the future, but if they assign it to you in June they can still put a date up to September (3 months from the ...

Re: Tier 2 visa and COS timings

CoS has an expiry date of 3 months, but what is the start date on it? When you say your employer got approval for the CoS, does that mean they got an allocation for it or have they already assigned a CoS to you? If it has been assigned in June then you can still apply in August as it would expire in...

Re: Today Tier 2 Extension - Queries- Urgent Help

aplinhar- From what I have read, that seems to be the case. I am going to do the same next month. My visa end date is 14th December but I will apply in July for an extension (with CoS start date possibly in October), so will get the new visa beginning July/August, whenever UKVI approve it. The end d...

Re: Tier 2 Extension Questions

You're welcome! And don't worry about it, I have asked plenty of dumb questions recently! The thing is, since yours is an extension, you can't stay beyond 6 years on a Tier 2 anyway. So even if you apply early and thus the start date on your visa would be early, it would be valid until the end date ...

Re: Tier 2 Extension Questions

If the start date on your CoS is 1st September 2016, the earliest you can apply is 3 months before that date, so 1st June 2016. The guidance states that you are allowed to apply within 3 months of the issue of the CoS, and 3 months before the start date, and that the start date on the CoS can't be m...

Re: Tier 2 extension and Dependant visa question

Thank you again for your detailed reply! So it doesn't matter if I apply more than 3 months before my visa expires and thus the date on the CoS is more than 3 months early as well? Of course in this case I will probably be applying either the same day or the next day that my employer issues the CoS....

Re: Tier 2 extension and Dependant visa question

Hi TrueBlue! (You won't believe in some forums my username is actually ShrutiBlue19 too! ) When the CoS is assigned, there has to be a start date mentioned on it, which according to the rules has to be one day after the expiry of the current visa. So even if the CoS is issued today, the start ...

Re: Salary change timing (answer will be appreciated)

I have another question related to salaries. Re: Tier 2 extension and Dependant visa question

Also, just to confirm, my new visa would be valid up to 14 days after the end date on my CoS right? Instead of paying for another year of NHS surcharge I thought I would just apply for a two year visa and ILR when I'm eligible for it.

Re: Tier 2 extension and Dependant visa question

Thank you for your replies guys, I think that is what I will do- apply for an extension of my visa before I get married. I hadn't realised that you could extend your visa any time before it expires. Which brings me to another question. If I ask my employers to issue a new CoS for me with a start dat...

Tier 2 extension and Dependant visa question

Hi guys So my boyfriend is doing an MBA in the US and his course will finish at the end of August. I wanted him to come to the UK as its easier for him to come here as a dependant and find a job than me finding a job along wit sponsorship in the US. We want to get married this year as soon as his co...
