There was a case that ruled that a person's current immigration status doesn't preclude them from applying for a visa under the Directive on Free Movement. Not sure of the case but I guess some of the more experienced members will know. If she was to apply for a visa for Spain, she (in theory) can't...

Getting the EEAFP might not be a problem. but the issue of dual nationality would come up when applying for EEA2; the form specifically asks if the sponsor is a British citizen. Hey there Yeah - sounds like we're stuck in the boat indeed...and in the same part of the world. haha. I'm still going with the Surinder Singh route via another EU country. I've never considered the UK spouse visa (finances...) but I've noticed that some people say that it's now 5 years for citizens...

Just a note: time in NI only counts as residence towards Irish citizenship for spouses of Irish nationals... A UK citizen would not be able to get Irish citizenship for his/her spouse via NI

I'm sure most people know that already...but I didn't want to give a confused message... :)

There's even less guidance on the Ireland Surinder Singh position than the UK one. If you're not in a major rush to get back to Ireland, you could still have your partner stay with you in Northern Ireland under the UK EEA Family Permit. That time still counts towards his 3 years of residence in Irel...

There shouldn't be fee but remember that WorldBridge is the processing company. They will have their own rules. You actually need to address your query with the [British] Embassy in question. That sounds fine then.

They could take the train or Bus Eireann (they used to have a direct bus from Dublin Airport to Belfast). Both take just over 2 hours. Can't remember the price but I'm sure the OPs spouse should know.

I'm not really sure about this works but, in theory, they shouldn't be asking for proof of funds. However, someone else on this forum said that he was asked to show proof of having about 1300Euro per month to support him and his family. Never heard of Spain doing this. Hope someone comes back to you...
