Re: EEA2 Student - Refused on insufficient funds grounds

Hi, I sent an email, and they just confirmed that there is no limit (upper or lower) specified in law, and that it is assessed on an individual basis whether it will be sufficient funds; but also reminded that a declaration in itself is not a proof of sufficient funds, and that it has to be accompan...

Re: EEA2 Student - Refused on insufficient funds grounds

I was wondering if I could, please, get some advice of what is the best thing to do from now? -call someone at the UKBA and point out that they haven't fllowed the guidance properly on that point? "If the applicant chooses to make a declaration you must advise them to confirm they meet the abov...

Re: EEA2 Student - Refused on insufficient funds grounds

Indeed, £16,000 doesn't seem compulsory. By looking at the link provided by sheraz7 https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/284168/Free_movement_rights_V10_0EXT.pdf , under the paragraph "Assessing sufficient resources". They mention that "If they exc...

Re: EEA2 Student - Refused on insufficient funds grounds

Here is the thing: I originally thought that I could call them and point out that having been given the choice to simply provide a declaration as proof of self-sufficient funds, it was arbitrary of them to suggest that I had not enough resources, when the bank statements that I provided where not su...

Re: EEA2 Student - Refused on insufficient funds grounds

Thank you sheraz7 for pointing me to the text and for your advice. I am sorry to ask that, but it feels like it could be crucial: "You must not insist documentary evidence of available income or resources is provided. " What does this mean? Honestly, it seems to me that some words are miss...

Re: EEA2 Student - Refused on insufficient funds grounds

Thanks for the reply! Yes, it was my understanding too. What do you think are the options now? Does he have to appeal, or can we simply try to call the UKBA to point out that fact? Also, do you know of any kind of text that would support the fact that they're not allowed to ask me for any amount of ...

EEA2 Student - Refused on insufficient funds grounds

Hi, I would please need your help regarding the EEA2 refusal my partner received, and advice on what is the best way to proceed. My non-EEA civil partner applied for an EEA2, me being a student. We sent a few bank statements to serve as a proof of address. They replied that he hasn't provided suffic...

Re: COA with no right to work BUT we ARE married

Hi, Thanks a lot for starting this thread! It gives some hope and ideas of how to proceed. My non-EEA partner has applied for a EEA2 and received a Certificate of Application this morning stating: "At this stage we are unable to confirm your right to workin the United Kingdom. This will depend ...

Could you please tell me which document I should refer to, in order to have the details of rights and responsibilities relating to the Family Permit, and EEA applications?
Absence is actually not the only issue I have been wondering about..

Are we talking about the family permit? It lasts 6 months, I am surprised that I can be absent for up to the whole period of his permit validity.

Hi,
I don't understand their answer. I have a subscribed to student health insurance from WPA very recently. (I don't know yet if mine will be accepted by the UKBA)
They require to have been registered for at least 6 months with a GP's surgery. So it should have been ok for your wife..

Hello, I am the EEA civil partner of a non-EEA who is living in France with a student residence card. We are both students. We have submitted the online application for my non-EEA civil partner a few days ago, and his meeting at the VAC is in a couple of days. I am trying to find the right balance a...

Thanks. I'm not sure I understand what you mean. My understanding is that a EHIC just reflects that you have health insurance in a given country (I guess in the UK, it can simply mean someone is entitled to NHS, hence not enough for the UKBA). Anyway, in this case, I was thinking about providing EHI...

I called UKBA a few days ago to clarify what needs to be covered by comprehensive insurance and was told that accidence and emergencies need to be covered. But generally, the guys didn't know themselves what they want. I called twice. First time I asked that if my husband (non-EU) is still working,...

I am a French national and have been residing in England, as a student, since october 2012. I have applied to, and received a registration card a few months back....
