Re: Struggling to pay taxes aftr setting up business Tier1

@ silhoutte, you ask this question ''Should i declare bankruptcy'', How on earth do you want to declare bankruptcy over council tax debt except if you have some other big debt problem which you are not telling us. Why don't you move to another business if your present business isn't turning profit. ...

Re: Entrepreneur visa refused (contract via recruitment agen

@ p2s7721, your case is one of the first I have come across after the changes of July 11, 2014. I think that HO does not want contractors going through third party (recruitment agency) rather they want contractors/applicants to have a contract directly with the client (in your case, the bank). I wil...

@ MTZ510, your point is very important and the OP need to be very careful and start trading as little as possible to avoid dormant account for his first year.

Re: Partnership in business

@ imran10, yes you can decide to open a new company with your friend and use the new company for your extension. In regard to dissolving your old company, its your choice to decide. The only important thing is that if you have invested part of your investment funds in the old company and you plan to...

Re: change of route to 200k from 50k

@ Celina, HO will be more than happy if you decide to show investment of 200k rather than 50k, there is no rule for changing your mind and you don't need to inform HO at all. You just have to invest the 200k and show HO during your extension. The main rule of the entrepreneur visa is the investment ...

@ naveencandy8, your money must have come from somewhere, either savings, gift, employment income e.t.c. You might be ask to show proof of where the money come from, so be prepared for such question. It might be a good idea to take along with you to the interview old bank statements showing how you ...

Re: Urgent - Dependant Leave different from Main applicant

@ marcnath, if you move to UK 2months after being granted your 3yrs 4months visa and your spouse 3yrs, it means that by the time you have spent 2yrs 10months in UK, your spouse visa will have expired. My advice is as follows; First submit an extension for both of you about 2days or so before your sp...

Re: Business Loan

@ imran10, as long as you are able to show the investment of 50k, you don't need to tell HO about your business loan as its your personal issue to deal with. If your bank allow you to pay back the loan for 10yrs then its not HO concern. Just show proof that you have invested 50k in your business and...

Re: Entrepreneur Visa big problem

@ naveencandy8, if you have corrected all the mistake in your first application, then your second application should be fine as long as you can show proof that you have invested your funds and that your business is actively trading. You should also be prepared to answer questions about the source of...

Re: change of route to 200k from 50k

@ Celina, if you decide to now invest 200k in your business rather than the 50k you initially planned for, then you will have more flexibility in the business you can do apart from property management. You can also use the 200k funds to your advantage if you can employ 10 full-time workers for a yea...

Re: Partnership in business

@ imran10, yes you can be in partnership with a friend that is not your entrepreneurial team member, but you will have to show your own 50k investment proof in form of either director's loan or direct cash transfer into the business account, but the former is the best option. You should also be a re...

Re: Can I start my business in the second year?

@ IGisele, did you apply through the 50k/NQF level 4 business route? If yes, then you need to think very well about ''organic skin care business'' as it doesn't seem to meet HO requirement. You can start your business at your own time before the 3yrs, but its very risky as you might be question if y...

@ aseementerprener, since HO sent you a letter claiming that you did not attend the interview rather than your interview to be reschedule it might imply that your call about being sick wasn't pass on to the correct department. I will advice you to call or send an email to HO and demand for the inter...

@ nagisons, you can invest in any company that meet the requirements of HO in terms of NQF level, but you will have to be a director of such business if you want HO to recognise your investment in such a company.

@ niceguy200458, it doesn't matter if you have stop working for your previous sponsor, you are still allowed to do the supplementary job as you have a pending application and your previous visa is still valid by virtue of section 3C, but the job must either be at the same level and sector which you ...

Re: Visa refused.how manydays i can stay legallywithout over

@ Aravindv, send an appeal to the FTT and you will have an average of 3-6months or even more to prepare for your departure. Since your application was refused based on not meeting the requirement for business to start before July 11, 2014 it might be very difficult to convince the judge to allow you...

Re: Can I work part time while I wait for Entrepreneur Visa?

@ niceguy200458, technically your previous Tier 2 general visa is still valid by virtue of section 3C and d same rule on supplementary job is still applicable to you. So you can take up a part-time job role as stated in the requirement.

@ ifti01, your solicitor should write to HO explaining that you did not receive any refusal letter and HO are very likely to re-issue the refusal letter with appeal right if you can prove that the letter was not receive by either you or your solicitor.

@ baller1432, if your application to appeal court get refused you can still submit an FLR(FP) application under article 8 base on your private life in the UK, you are likely to get a refusal but will also get an appeal right which you can drag till you complete your 10yrs for your ILR.

@ baller1432, do you have any kid born in UK, if yes, you can consider applying for FLR(FP) under article 8 and then drag it out till you clock 10yrs as you will get an appeal right if refused under article 8 right to private life,

@ hazmalik, getting a removal notice with your refusal letter is not much an issue as HO do issue removal notice with most refusals even with appeal right. Its just a standard way of their one stop approve to combine cases so that a judge can easily decide on removal if the appeal get turn down rath...
