Re: Tier 1 Entrepreneur Twice Refusal

@ sri0805, you should not have requested for your original documents from HO as they are very unlikely to send them to you in order for you to make a fresh application except if you decide to leave the UK. To submit a further application you should have simply completed the required application form...

Re: Can I study part-time ?

@ anas_19, with entrepreneur visa, you are a director and also an investor so you don't necessarily have to be a manager of the business if you can employ a capable hand to run the business for you while you undertake your full-time study. Being a director of a business does not mean you should be w...

Re: Tier 1 Entrepreneur Twice Refusal

@ sri0805, did your solicitor submitted a Judicial review letter after your re-consideration request was also rejected? If not, then your case is now more complicated than before. What date was the last reconsideration request rejected as you can still submit a JR PAP letter if its not more than 90d...

Re: Funds issue

@ imran10, if you registered as a director of your company which you used to get your visa, then you don't need to worry about the requirement to register within 6months of getting the visa as you have already done so before you apply.

@ imran10, you cannot join another team member after receiving your visa as a single applicant, the only solution is for both of you to re-apply as entrepreneurial team if you want to extend together using the same fund.

@ Ramos, yes you will get a right of appeal if your ILR application got refused for submitting it early.

Also the time you spend for your appeal will count towards your 10yrs legal stay in UK.

@ HITS123, online sales of fashion stuffs is not NQF level 4 except if you are a fashion designer.

Having the job role of ''customer relation manager which is level 4'' does not make your business to be at NQF level 4.

Re: Extension: Employing on 40h per week basis?

@ sky_rise, I think the reason why they stated that they will be calculating hrs is to make sure applicants employ someone on at least 30hrs pw in order to qualify for full-time employment rather than someone just paying a particular amount to staff and then claiming it to be full-time when in-fact ...

Re: Extension: Employing on 40h per week basis?

@ sky_rise, the employment mixture is only applicable to duration and not hours as per your plan. HO has stipulate 30hrs pw minimum for full-time employment, if you decide to employ a full-time staff 1 on 40hrs pw then the extra 10hrs pw for that particular staff 1 cannot be added to another part-ti...

@ hallowvip, you don't need to contact tribunal as your appeal will be automatically withdrawn once you leave the UK. You only need to call HO to arrange your passport collection which I understand might be given to you at the airport on your departure day.

Re: Urgent help Needed

@ Ramos, at the moment your status is still as PSW visa holder and it will still continue if you decide to VARY your Tier 1 entrepreneur to Tier 4 student visa. As long as you fill in the correct specified form and follow the guideline for varying a pending application, then your legal status still ...

@ Atif786, the rule on NQF level 4 was introduced in April 2012 when PSW visa holders were allowed to use 50k cash instead of the 200k requirement for some applicants'. So which of your friend is extending after just 2years? Try to get your fact right. With the 200k route, NQF level 4 is not a crite...

Re: Is business account is Manadatory ?

@ imrankhan88, business bank account is very important and should be submitted with your application. If you are unable to open one before the submission date, then it should be ok.

But normally, HO will expect a genuine business to have a UK bank account for its transactions.

@ riaz1982, if you have a good immigration history, then your ILR should be a straight case as you are more than qualified for it.

You can submit your ILR application within 28days of FTT refusal.
Best of luck.

@ premcomm, the refusal points in my opinion point to the fact that your business is not very active. I might be wrong. How many business transactions have you got prior to your second application? Refusal 1: You definitely need to prove why someone will give 50k for business without no explanation ...

If you know that you have done something fishy, then you can switch/VARY to another category, but it will be a good idea to wait for the 28days maintenance fund before submitting a fresh application.
