Re: Refusal based on NFQ Level 4

@ benjamin2000, if you will qualify for 10yrs long residency by Sept. 2014, then your best option is to continue the JR process and then submit your ILR application about 28days before you complete the 10yrs while your JR is still on-going. You do not need to withdraw your JR while submitting your I...

Re: Money invested during application process

@ dancingguy05, since you already transferred £4,000 into your business account, then you only have to transfer the remaining £46,000 within the 3yrs of your visa before extension. Don't worry too much about the £50,000 in your personal account now as long as you can show that the remaining funds ar...

Re: Can I apply tier 2 visa after withdraw tier 1 appeal

@ Anaz786, your last leave will still be PSW, so no need for the labour market test. You can withdraw your appeal and then submit your new application on the same day. Fax the appeal withdrawal request to the tribunal and also send your Tier 2 application on the same day. Doing this will make your w...

Re: Refusal based on NFQ Level 4

@ benjamin2000, I think your business is retail (buying and selling) which is below NQF level 4. It will be very difficult for you to claim the SOC 3422 NQF level 4 (Product, clothing and related designers) at the judicial review since you didn't include it in your initial application, but you can t...

Re: Refusal based on NFQ Level 4

@ benjamin2000, bicycle cafe seem an unusual service under NQF level 4, can you explain fully what your business offers to its customers? Being a manager of a company doesn't make the business to be at NQF level 4, you as a manager is simply doing an NQF level 4 role but what role does your business...

@ joe911, you can call the tribunal to confirm that your appeal has been received and you can then wait for the hearing date after which you can withdraw your appeal and then submit your Tier 2 application.

@ aliav09, you don't need to withdraw the appeal, let your dependant call HO and request that she need her passport for emergency travel and HO will either send passport to her address or ask her to book flight ticket and pick up passport at airport on the day of her travel. Meanwhile, her appeal wi...

Re: Entrepreneur Refusal ( please advise )

@ fawwi786, best option is for you to make a fresh application as you admitted that you didn't provide enough documents in your first application during your appeal hearing. By submitting new documents in the right format during an appeal, you have invariably admitted that HO was right to have refus...

@ MTZ510, You cannot buy a property for the purpose of refurbishment and management/letting and then use to claim investment points under the Tier 1 entrepreneur visa either through 50k or 200k route. The other form of property that could be used for business purpose are those bought with the intent...

Re: 10 years ILR & Apeeal refused

@ Mrs P., as long as you don't have any bad immigration history, you will get your ILR as well. From what you stated, you applied after your appeal have been decided at FTT and before HO appealed to UT. If you have spent 10yrs legal stay in UK and you then apply for ILR, the ILR application has prio...

Re: Complicated Tier I E route - already invested! Help Plea

Re: urgent advice Tier 1 Entrepreneur Refusal& appeal 21/05

@ Bhavin001, if your refusal reason is only that you do not have money in your account, then I will say that you have a very high chance of winning your appeal if the 50k funds was in your personal account as at the time of your application. If you have ticked available funds in your application for...

@ computer9000, yes you can use joint account which is outside UK, but the other party in the joint account need to give you a declaration to state that you both have equal access to the joint account. You should also indicate how much of your own funds is in the joint account.

@ kash790, the mistake might not have any effect on your application but you can still send them a letter to explain that you did tick the wrong box. At least that will give you rest of mind that you try to correct the mistake.

My comment was based on how much was needed and not if he need to show his own £900 again. I think its not necessary since he already got his own visa.
