With a 10 year Long Residence application, I think you only need to show you were here legally for the whole time. I think there are no work restrictions under PSW, but isn't a Tier 2 visa connected with a single job? If so, could there be a potential problem where the self employment overlaps the Tier 2 (from March to August 2013) ? An FOI from 2014 seems to indicate self employed work is prohibited under Tier 2.

If the application for ILR is refused based on this out of time period of 38 days, how could it be challenged in court? When the application for ILR is made, there will be existing leave. Does that mean it won't be possible to appeal the decision and it must be challenged by means of Judicial Review?

Thanks sushdmehta, that's helpful. You did not become an overstayer on 30-Apr-08 but on the second day of the date of postage of the refusal letter. I am not sure what you are saying. Do you mean the original grant of visas after the rejections in 2008 and 2010 were only granted due to discretion? And therefore the ILR would only be granted if the officer decides to allow it? I think at least the 2010 grant of leave was well within the rule, so ...

I found out the answer to this a long time ago and forgot I had posted the question. ECAA1 dependants can work or study with no restrictions. After 3 years of working, they build up their own right to work (similar to the main ECAA1 visa holder, but without the need for a dependant visa).

I am preparing for an ILR application based on 10 years Long Residence, starting with a tourist visa visit in 2006. I requested a SAR on 8 May 2015 and it was sent 12 June 2015, so just over 1 month. The cost is only £10 and it may take less time than 2 to 3 months, so you might request it while you search for another way to verify the dates.

ECAA1 dependent study?

Hello,

Does anyone know if an ECAA1 Turkish worker dependent can study in the UK? I've seen guidance that the dependent cannot work until after they have been resident in the UK for 3 years, but I cannot find anything about whether the dependent of a Turkish employed person can study.
