Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

Applied for Zambrano Settled status (EUSS) in January 2021. Home Office refused the application in April 2021. Appealed to the Immigration Tribunal immediately. Appeal was based on paper (no legal representation). Included in the bundle were skeleton argument and witness statement using the informat...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

Just so you know, in my DFR1 refusal letter, the Home Office encourage me to leave the country knowing that I am a parent of a British Citizen. So they just don’t care about the future of our children. So, why did HO "encourage" you to leave the UK than applying for a deportation order? M...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

@Mata, You dishonor all of the Zambrano carers who had to fight Social Services from 2012 onwards to remain with their children with your comments. I have asked you to provide evidence of British children who were removed from the care of their parents and became look after children because their p...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

Here are a few quotes taken from an article: As the Zambrano infants are UK citizens residing in the UK, and therefore not migrant EU citizens, they do not fall under the Citizenship Directive. Neither the UK nor the EU specified what rights they will have. They were also ignored in the final stage...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

So the Zambrano carers who were deported from the UK, who had their children placed into foster care, just imagined it? I would appreciate it if you can provide evidence of court orders ordering deportation of parents of British children. There are no citizenship rights for Zambrano carers. I dont ...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

The Home Office works VERY closely with Social Services. Social Services has been putting British children of Zambrano carers into foster care since 2012. Do you see? Zambrano carers do not qualify for important benefits. They have to go to Social Services and ask for support under Section 17. But ...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

[/quote] Good question! Only the Home Office knows They are capable of everything! I even saw an article where they were discussion around this question, I think it was the judgment of Luiz Zambrano itself. They were an argument whether the child could be sent to care 🙄 How can someone even think li...

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

The key is to avoid being forcibly removed after 31 December 2020 while the judge decides your case. You could be a target for a removal because you will not have LTR and the Home Office will likely say you are not a Zambrano carer. So, if the HO removes/deports me to my country would they also rem...

Thanks. So that mean she won't need to apply for a new leave as a parent of British child?

10-year route as partner: Relationship breakdown

Confused of what is the way forward. This woman was granted limited leave to remain (30 months) on the 10-year route as partner of a British citizen under Appendix FM with no recourse to public funds. However, the relationship has broken down completely and the British citizen partner has moved out....

Re: Regularizing status of a child: Which Form to use?

Assuming the requirements of 298 have been met, as appears to be the case, ILR should be granted. SET(F) would be the form. She does meet all except 298(ii) which states that she has or has had limited leave to enter or remain in the UK, though I am not sure of the meaning of the phase in bold. Als...

Re: Regularizing status of a child: Which Form to use?

It may be more advantageous to settle the child now. Thanks Amber. I thinks I will advise them to apply for settlement. With regard to the appropriate form, I have narrowed down two forms: 1. Form SET(F), i.e. Application for Indefinite Leave To Remain In The UK as a Child Under the Age of 18; and ...

Re: Regularizing status of a child: Which Form to use?

Therefore representation has to be made on behalf of the child, as to why he or she should be given ILR. At some point the parent could seek to register him or her under section 3(1) of the British Nationality act. Thanks Obie, In your earlier posts in another thread (see http://www.immigrationboar...

Re: Regularizing status of a child: Which Form to use?

I believe there is a 7 year route for children. Yes, there is a 7 year route for children, but this particular child has been in the UK for less than 7 years. But offcourse, has to wait till become eligible and then apply if no other option before then. Even if she qualified under the 7 year route ...

Regularizing status of a child: Which Form to use?

I am a bit confused on which form should be used to regularize the status of a child aged 10 who is an overstayer. She was born in Kenya (she is Kenyan) and came into the UK five years ago with a visitor visa to visit her mother. She has not gone back to Kenya since then. Her mother also originally ...

Well not just for the form MN1 ! Simply what is their nationality? Needless to say I have no knowledge of the nationality laws of Malawi and Jamaica, but you need to check whether nationality of those countries has been inherited from the relevant parent. However a quick look on the internet seems ...

Child's nationality (or lack thereof) is irrelevant for section 1(3). You could put down "None (probably eligible for Indian citizenship but not yet registered)" JAJ, that makes total sense to me. Harshid, I think you are concerned about something that is really not worth worrying about. ...

MN1 section 1(3) Registration: Child nationality, etc

First, on the MN1 form, section 1.9 asks for present child nationality. Children were born in the UK to parents of different nationalities (Malawi and Jamaica). Parents were not yet settled at the time the children were born. Parents now have ILR. Parents are not married, but live together as husban...
