I think that your point is similar to mine. I was looking at it from the angle that He MUST NOT be in a relationship with her in order to qualify for the parent route. Either way he MUST be separated from her in order to qualify for the parent route.

Obie, I don't think that the issue is that he is living with the children. His problem as I see it is to be able to proof that she is NOT in a relationship with the lady.

What I mean is that there would have been no issues if you were working and claiming working tax credit with your husband's name on it. As it stands now, technically your husband is the one claiming not you.

You can only claim income support when something is preventing you from working. You can apply for JSA as couple. You must show that you are available and actively looking for work. They will calculate to see whether you qualify for contributory JSA or not, if not they will pay you you income based ...

Does your husband has recourse to public funds? If not he can't apply for working tax credit. You applying for child tax credit and adding his name is different from him applying for wtc and adding your name.

Thanks Guru for your prompt reply? What I am thinking about is that maybe I might be asked to show my visa when my wife includes me in the benefit application. Also, the amount awarded may be higher than what she is entitled to. Thanks once again.
