Parent of UK child

I am trying to get information for a friend. Her cousin is married to an Algerian national who is currently living in the UK on a spouse visa (since July 2014). However, they are considering separating but are worried about the repercussions on the husband's visa status. They have a 3 year old child...

Re: What will happen if rules change again?

Thank you Casa. My daughter is on a disability benefit so they were able to apply for spouse visa under the adequate maintenance rules. If my daughter loses the benefit or the Government no longer accept this as an exemption, would she then have to be earning the minimum income to apply for Further ...

Re: What will happen if rules change again?

Does anyone know whether a couple can claim Working tax credits if it is the partner subject to immigration control who is working? If they can't claim WTC and the Government significantly reduce Child tax credits, affecting large families, is there anything else that can be claimed? Child benefit s...

Re: What will happen if rules change again?

Thank you Casa. My daughter has children from a previous marriage and two to her husband. I find it hard to believe that they could ever be separated but worry about what this Government may do.

What will happen if rules change again?

Does anyone have any idea what might happen (based on previous instances) if the Government change the rules again with regards to the spouse visa. In particular, if applicant was given leave to enter due to sponsor's disability and thereby only having to prove adequate maintenance. If the Governmen...

Re: Adequate maintenance and Income Support

Hi Can someone please help me understand how the benefit system works once my son in law comes to the UK on a settlement visa. My daughter is exempt from the new rules and had to claim adequate maintenance. Now her husband is coming she will lose her income support which apparently will lead to her ...

Re: Adequate maintenance and Income Support

I would like to thank all of you on here who have given advice, particularly Amber, who enabled us to set out my son-in-law's visa application. It has been a long wait, but today he got his visa:). Such a relief for us all. Good luck to everyone who is still waiting.

Re: Adequate maintenance and Income Support

One last question! If adequate maintenance is proved and everything else is good, can the application still be refused if the VO doesn't believe he has realistic chance of a job? Thank you.

Application for settlement

Please can someone tell me if a property inspection report is necessary to prove adequate accommodation. Need to send bundle today but just read that without it the application will be refused. Thanks.

Re: Adequate maintenance and Income Support

But I thought it was more about being entitled to more as opposed to actually claiming it? So even if the sponsor didn't claim extra support, the applicant being entitled to it would lead to a refusal. This is what is worrying me.

Adequate maintenance and Income Support

Sorry if I've already been told this (so stressed with all this, I'm not sure what I've been told. My daughter is exempt from the financial rules due to a disability, and her ONLY source of income is benefits. One of those benefits is Income Support. Can someone please clarify that her husband joini...

Re: Help please on Appendix 2 Financial Requirement Form

Thank you for replying. For the last question do you think it's acceptable to write ' none other than the children mentioned above' as they are the only ones the sponsor is financially responsible for? Thanks.

Help please on Appendix 2 Financial Requirement Form

Hi. I am desperate to know how to answer a couple of questions on this form, can someone please advise me? Question 4.13 - How much of your sponsor's total monthly income is given to their family members and other dependents? What should be included in this, if, for example the sponsor has three chi...

Re: Presentation of bundle for spouse visa application

Sorry if this is posted in the wrong place, but does anyone know how to answer the question on the financial form regarding how much the sponsor spends on her children? I've no idea what to include in this figure and whether the decision maker will use the figure to dispute that there's not enough l...

Re: Presentation of bundle for spouse visa application

Thanks Rayking. Sorry you're right, the other question wasn't clear. I'm referring to all the evidence sent such as support letters. Bank statements, birth certificates. Do these all have to be labelled with applicant name etc?
Thank you.

Re: Presentation of bundle for spouse visa application

Can anyone tell me if name and passport details need to be on each page sent? If so, can these be written on afterwards or put on stickers. If the sponsor has previously been divorced do they need to show birth, marriage and divorce certificates or is just the decree absolute needed?
Thanks

Re: Presentation of bundle for spouse visa application

Thanks, but do I make the quote about the upper tribunal case of Ahmed... Or do I just put in the figures? Does a weekly/monthly payment have to be showing ON bank statement for PIP and Housing Benefit? The payments showing for both of these include 6 months backdated payment.

Re: Presentation of bundle for spouse visa application

Thanks Amber. Does the sponsor's copy of passport have to be certified, and if so, by whom? Also you have me a link to show how to set out financial information to prove adequate maintenance. The link was from advice you gave for an appeal so I was wondering if I still include the paragraph starting...

Re: Presentation of bundle for spouse visa application

Hi there
I'm a little confused AGAIN! When an application for spouse visa is submitted online, does every other application, ie. Appendix 2, Financial Information just have to be printed and taken to the appointment or does this have to be submitted online as well?
Thanks

Re: Presentation of bundle for spouse visa application

I did a contents list so they could see what exactly I had included in the documents and organised everything into sections accordingly (personal info/proof of relationship/accommodation/finance) then put them into paper folders. Unfortunately much of our documents were mislaid despite all our effo...

Re: Sponsor reliant on public funds

Thank you. With regards to the financial information when you have to prove adequate maintenance, it asks how much per month is spent on those you are financially responsible for. In my daughter's case, this is her children. How on earth can she come up with a figure for each child individually and ...

Re: Sponsor reliant on public funds

Hi there
As my daughter, as the sponsor, gets disability benefits plus other benefits, does she still have to provide 6 months bank statements even though her previous statements will show less money going in than this month and future statements?
Thank you.

Presentation of bundle for spouse visa application

I hope someone can advise me on what is the best way to present the information for a spouse visa (leave to enter). On previous visitor application we were advised to put everything in a brown envelope, but I am worried that with so much paperwork some kind of file would be best. Do we need a conten...

Re: Sponsor reliant on public funds

To put my mind at rest, do you know what kind of benefits are likely to increase if an applicant were to join their spouse in the UK? With regards to setting out the financial information, would we fill out the online form and then my daughter's husband put in an additional sheet of financial info w...
