Re: Tier 2 General Extension supporting documents requiremen

There's no need to submit an actual physical copy of the CoS.
All you need is a COS number and consistent information for your application - sponsor licence number, address, correct dates, job title, salary etc.

Re: HELP ---Tier 2 refusal

1. Should my company to email/call UKVI to address this problem without making application? No - they would need to submit a fresh application for 3 years. 2. For new COS, is it possible to use the same start date I used for my refused application? Yes, it is possible to choose any date in the futu...

He can switch from Tier 4 to Tier 2 from within the UK - that would be the easiest option - HOWEVER, in order to be exempt from a Resident Labour Market Test (the employer having to advertise the position to settled workers first), he needs to show successful completion of his Masters. So definitely...

Re: Job promotion

What defines the situation there is the SOC code your current visa was issued for. Could the new job still be best described by the same SOC code as your current visa? In the affirmative, it's just a promotion - however a change in job title and salary would have to be communicated and you might hav...

Re: Urgent VISA interview help needed

Why would pre-selection be an issue if it's a job on the shortage occupation list?
It's exempt from having to be advertised to the settled workforce.

How is there a pre-selection? Pre-what?

Re: Length of time between employers?

Hope you mean outside the UK, otherwise we're not on the same page here. You have 60 days from curtailment letter to submit the application - your stay could then be extended while you wait for a decision on the application. In order to submit you need a valid CoS and (for most cases) that will requ...

Re: Is Employment Contract required to apply T2 dependent vi

The key one missing is the one showing your relationship - i.e. a Marriage Certificate.
I really don't think employer agreement is necessary, just your visa documents and the sponsor letter confirming maintenance is fine.

Re: Deception in Tier 2 general application

You're admitting your guilt by saying you bought a CoS. A genuine position would never require you to buy a certificate of sponsorship. Not knowing the law doesn't justify a crime. If you were actually advised by your solicitor to do this, that should be a crime in itself on his part - he facilitate...

Re: Tier 2 general CoS Dates query

I'm not in IT, but that's actually true for lots of industries.
But it's a risk, employers might not take you back if the new one is rejected. So it's quite difficult to juggle.
Good luck!

Re: Length of time between employers?

The timeline will also depend almost entirely on the new sponsor - are they already licenced, have they done a RLMT for the position, do they have Unrestricted CoS ready to be assigned etc. I recently went through this and it took around 3 months from last interview to getting the new visa approved ...

If the new application is rejected, she can even continue working with the current employer as long as her current visa is valid. Brave move to let the old employer know be...

Re: Tier 2 general visa actual status

The advice is to always tell the truth. Was this medical leave? You could have issues if you have stopped working for your employer for those months (or even for one month) without a maternity, paternity or sick leave justification. Were you still getting paid? Was the arrangement that this was temp...

Your sponsor might have written your job title like that on the COS - might be worth checking with them.
Otherwise, I don't see major issues... but always worth notifying if there is a discrepancy.

Re: 5 year cos vs 3 year application

There is a chance they will reject it if you apply for 3 - or simply offer you to pay for the difference.
But you cannot use the 5 year COS for a 3 year visa.
I would not risk it.

They cannot change the type of COS, I'm afraid. Either assign a new one or you apply for 5.

This should be fine, provided that:

- You didn't spend more than 180 days in any given year outside the country

- Your employer writes a letter confirming you were working during those dates.

See below for answers: 1: Question is all level 4 experience salaries range 19000 to 25000 normally. How UKVI demand 35000 on level 4 job. They can demand whatever they want. Remember, this is no longer a work permit, this is a settlement visa, so they're allowed to define the threshold earnings for...

Re: Assistance needed on further information required by Hom

Hi there, Both requests seem very specific to your position - therefore, I don't think anyone here would be able to advise exactly on what to show them without knowing more about the job/context etc. If there is a request for a business plan, it seems this is a brand new role, department or company?...
