There's no WAY they will issue him a settlement permit because HE IS BRITISH! Your reasoning that it is too time consuming will not hold up. Just get him a British passport (and consequently, he will lose Indian citizenship) and OCI.

That can't be legal since EEA family members have the automatic right of residence without documentation (apart from the marriage certificate, and adoption document). Contact SOLVIT.

PR is automatically derived after 5 years of the EEA partner exercising treaty rights (both you and your spouse and kids will get it automatically). This is true, but many institutions don't KNOW this, which is why it's good to know that DVLA and some banks are cooperative/understand, or just clueless :)

You can stay in the country and apply for the RC because, if your partner will already be exercising treaty rights, the rights extend to you automatically. Visas and such that are still valid are routinely shown on expired passports along with new passports. It's not an issue.

Well, either way, depending on how long he's been in the US out of status, it will trigger either a 3 year ban (if out of status for between 6 months and a year) or a 10 year ban (if out of status for more than a year) when he leaves the country even if they don't find out when he's still inside.

I don't think a child can renounce British citizenship that it automatically obtains at birth, nor can parents do it for the child. This is how it is in the US, so I am assuming it's the same in the UK. The CoE sounds like great option. It's too bad the US doesn't have something like this.
