Well I know the 3c/3d guidance says that ppl are not entitled to make fresh application when 3c/3d is in force, however I called UKBA and a women told me that you can make a fresh application but you are counted as overstay from the day u received ur refusal letter, but since I called on the 9th day of my refusal, I can't be sure that she was aware of the time. But a solicitor has told me that you can make a fresh application within 10 days in or out of the UK but still, you are overstay from the day you received ur refusal letter. Best way so far I have realized is that appeal, and make application on the day of withdraw, though I have missed the opportunity and did not appeal. what you were told by UKBA is incorrect. Section 3C leave applies while an appeal is outstanding or whilst an appeal can be brought. But Do I have the right for apeal because I have received my refusal on 31 January but I applied new application on 6th feb.i got there answer on 1st march.
