On T1 Gen moving to US

Post by Konaine » Sun Mar 02, 2014 1:19 pm

Hi All,

I am currently on t1 general. I have had my extension and will be eligible to apply for ILR in April 2016 or Sept 2015 if I apply on the 10 year rule. My problem is that the company i work for wants to transfer me to US office for 2/3 years. Can someone please tell me what implications this will have on my UK Visa and ILR and if I will still be eligible.

Many Thanks in advance.

k.

I would personally suggest you to decline this offer of moving to US.
Why?
- this will break your continuity in UK and create complications to go for ILR
- theoretically, you can keep on extending tier-1 even based on overseas salary, but who knows what UKBA may come up regarding change in rules/policy guidelines to hamper your timeline OR may stop Tier-1 extension (i don't belive this option though)?

Not scaring you but highlighting potential problems. hope helps?
